Regular City Council Meeting <br />Monday, August 22, 2016 <br />Page 31 <br />preference that life safety items could have been addressed before the July 28, <br />2016 deadline, but that was not accomplished, causing staff to pursue moving <br />forward to the City Council with this request to initiate the abatement action and <br />rescind the building's Certificate of Occupancy. Mr. Englund repeated Fire Chief <br />O'Neill's comment of the imperative nature to correct the building's life safety <br />hazards immediately, then allowing the property owner additional and reasonable <br />time to make the remaining corrections in the building. <br />Mayor Roe reviewed the actions being requested by staff as part of the abatement <br />action as outlined as orders in the draft resolution (Attachment Z, lines 234 — <br />240), and in accordance with various sections of local property codes as detailed. <br />Mayar Roe noted this involved placarding the structure as condemned; vacating <br />the premises, suspension of the Certificate of Occupancy, and disconnection of <br />utilities. <br />At the request of Mayor Roe, Mr. Englund reviewed city code language for the in- <br />tent of placarding the building, condemning the facility in accordance with legal <br />readings of city code. Mayor Roe noted such action would typically signal to <br />most people that the building was targeted for demolition; with Mr. Englund clari- <br />fying that, in this instance, it indicated the building needed to be brought into code <br />compliance. <br />Chief O'Neill noted the potential and hazards to employees on site, and the com- <br />munity itself, if a significant structural fire should occur due to these outstanding <br />code violations. Chief O'Neill specifically requested that the building be posted <br />as unsafe, warning employees and visitors to the site that they cannot occupy the <br />building. <br />City Attorney Gaughan concurred, noting this essentially provided public notice <br />of the hazards. <br />Discussion ensued as to the type of business currently occupying the facility <br />(truck repair) and number of employees (unknown to staf�; status of the electri- <br />cal system as evidenced by photographs attached to the RCA (Attachments T— Y) <br />and additional fire hazards and additional repairs needed to the fire sprinkler sys- <br />tem as part of those electrical issues and further impacted by a break-in to the <br />building and stolen copper piping, with noncompliant adjustments made through <br />use of temporary lines and extension cords. <br />Mayor Roe recognized representatives of the property owner at this time. <br />John Paul Martin, Martin & Squires, PA, Attorney for porso Building Com- <br />pany, LLC <br />Mr. Martin introduced other representatives of Mr. Dorso in the audience, includ- <br />ing owner of Dorso Building Company, Mr. Dorso; Bill Supina, property tenant <br />
