Variance Board Meeting <br />Minutes – Wednesday, May 4, 2016 <br />Page 2 <br />another condition stipulating that the property owner was responsible for confirming those <br />45 <br />corners, and subsequent confirmation by the city. <br />46 <br />Mr. Paschke noted that it would typically be the responsibility of the property owners. In <br />47 <br />this case, Mr. Paschke stated he wasn’t sure a survey would be necessary, even though <br />48 <br />the property owner may choose to do so for future reference. During his on-site visit, Mr. <br />49 <br />Paschke advised that he was only able to confirm one corner lot reference in the back <br />50 <br />yard. Prior to preparing this report, Mr. Paschke advised that he had asked the city’s <br />51 <br />right-of-way coordinator to establish property lines/corners to ensure they were on private <br />52 <br />property versus the right-of-way. However, Mr. Paschke advised that he was unable to do <br />53 <br />so before this report was disseminated, and confirmation of the proposed shed location <br />54 <br />was confirmed by city as-builts. However, Mr. Paschke advised that it remained his goal <br />55 <br />to return to the site to confirm the property lot corners. <br />56 <br />Member Gitzen suggested this would make sure the city was consistent in not doing <br />57 <br />surveys for private property owners and to differentiate the role of property owner and city <br />58 <br />staff. <br />59 <br />Chair Murphy concurred, noting that was his question as well, whether city staff’s role <br />60 <br />was transitive or confined to confirming the front property lot corners. <br />61 <br />Applicant Tara Anderson <br />62 <br />Ms. Anderson appeared at the invitation of Chair Murphy, and echoed the comments of <br />63 <br />Member Daire and her great experience in working with Mr. Paschke, and publically <br />64 <br />thanked him for his efforts. Ms. Anderson advised that her family had looked at multiple <br />65 <br />options over the last year before pursuing this particular variance option. <br />66 <br />Chair Murphy admitted he was leery about locating a shed in the front yard, but following <br />67 <br />his personal observation of the property earlier today, he revised that opinion based on <br />68 <br />the challenges of this particular lot. <br />69 <br />Member Daire agreed, questioning whether the far east property stake actually lies within <br />70 <br />a dormer of the adjacent property. Member Daire agreed that this lot was exceptional. <br />71 <br />Member Daire asked if staff had received any comments from residents or adjacent <br />72 <br />neighbors. <br />73 <br />Mr. Paschke advised that staff had received two phone calls as noted in the staff report, <br />74 <br />and one email since dissemination of the report; all supporting the variance. <br />75 <br />Mr. Paschke noted that Ms. Anderson had also consulted with their neighbors, and they <br />76 <br />were all supportive of the variance request as well. <br />77 <br />Chair Murphy closed the Public Hearing at 5:47 p.m.: no one spoke for or against. <br />78 <br />MOTION <br />79 <br />Member Daire moved, seconded by Member Gitzen to approve VB Resolution No. <br />80 <br />121 (Attachment D) entitled, “A Resolution Approving a VARIANCE to Roseville <br />81 <br />City Code, Section 1004, Table 1004-1 (Front Yard Setback) to allow construction of <br />82 <br />a storage shed in the front yard of the property at 2040 Irene Street, legal <br />83 <br />description on file in the Community Development Department (PF16-011); subject <br />84 <br />to comments, findings and conditions as outlined in the staff report dated May 4, <br />85 <br />2016; <br />amended as follows: <br />86 <br />Condition a (Line 112) amended to read: <br />87 <br />“The front property lot corners shall be located by the property owner and <br />88 <br />confirmed by the city.” <br />89 <br />Ayes: 3 <br />90 <br />Nays: 0 <br />91 <br />Motion carried. <br />92 <br />Chair Murphy reviewed the appeal process and deadline. <br />93 <br /> <br />
