Item 8h: Attachment <br />with other funds available for the operation of such pro��am (from all sources) will be equal to <br />or greater than forecast program expenses, it �vill approve such bud�et by resolution and supply <br />to the State Entity and the Commissioner of NIVIB certified copies of su�.h resolution and bud�et. <br />Section 2.05 Public Entity Representations and �Varranties. The Public Entity <br />hit-ther covenants with, and represents and warrants to the State Entity as Follows: <br />A. It has legal authority to enter into, e�ecute, and deliver this Aareement, the <br />Declaration, and all documents referred to herein, and it has taken all actions necessary to <br />its execution and delivery of such documents. <br />B. It has le�al authoriry to use the Pro�ram Grant for th� purpose or purposes <br />described in the State Pro�ram Enablin� Le�islation. <br />C. It has Iegal authority to operate the State Pro«ram and the Real Property and, if <br />applicable, Facility for the purposes required by the State Pro�ram and for the functions and <br />activities proposed in the Grant Application. <br />D. This A�reement, the Declai•ation, and all other documents refen-ed to herein are <br />the le�al, valid and binding obli�ations of the Public Entiry enforceable a�ainst the Public <br />Entity in accordance with their respective terms. <br />E. It �vill comply with a11 of the terms, conditions, pco�7sions, covenants, <br />requirements, ancl wan�anties in this AQreement, the Declaration, and a11 othzr documents <br />referred to hzrein. <br />F. It ��-i11 comply ��-ith all of the pro��isions and requirements contained in and <br />imposed by� thz G.O. Compliancz Le�islation. the Commissione�'� Ordzc, and the State <br />Pi-oaram. <br />G. It has made no material false statement or misstatement of fact in connection <br />with its receipt of the Pro�ram Grant, and all of the information it has submitted or �vill <br />submit to the State Entity or Commissioner of MMB relatin� to the Pro�ram Grant or the <br />disbursement of any of the Proaram Grant is and will be true and coi7-ect. <br />H. It is not in violation of any provisions of its charter or of thz laws of the State oF <br />Minnesota, and there are no actions, suits, or proceedings pendin�, or to its knowledge <br />threatened, before any judicial body or �overnmental authority a�ainst or affectin� it <br />relating to the Real Property and, if applicable, Facility, or its o�vnership interest therein, <br />and it is not in default with respect to any order, writ, injunction, decree, or demand of any <br />court or any governmental authority which would impair its ability to enter into this <br />Agreement, the Declaration, or any document referred to he�•ein, or to perform any of the <br />acts required of it in such documents. <br />I.
