Section 7.2� Third-Party Beneficiarti. The State Program �vill bene'it the State of Minnesota and the provisions and requirements contained herein are for the benefit of both the State Entity and the St�te of iVlinnesota. Therefore, the State of Minnesota, by and throu�h its Commissioner of NlivIB, is and shall be a third-party beneficiary of this �4�reement. Section 7.26 Pub(ic Entity Tasks. Any tasks that this A�reement imposes upon the Public EntiCy may be performed by such other entity as the Public Entity may select or desi�nate, provided that the failure of such other entity to perform said tasl<s shall be deemed to be a failure to perform by the Public Entity. Section 7.?7 State Entity� and Commissioner Required Acts and Approvals. The State Entity and the Commissioner of MVIB sha11 not (i) perform any act herein required or authorized by it in an unreasonable manner, (ii) unreasonably refuse to perform any act that it is required to perform hereunder, or (iii) um�easonably refuse to provide or withhold any approval that is required of it herein. Section 7.28 Applicabilit� to Real Property- and Faciiity. This Agreement applies to the Public Entitv's o�cnership interzst in the Rzal Property� ancl if a Facility eYists to thz Facility. The term `'if applicable" appearinQ in conj�inction �vith the term "Faci(ity' is meant to indicate that this A�reement ��ill apply to a Facility if one e�ists, and if no Facility exists then this Avreement wilL onLy apply to the Public Entity�'s o�vnership interzst in t!�e Real Property. Section 7.30 Jobs Reporting Requirements. Fursuant to Vlinn. Stat. � 16A.633, Subd. 4, the Public Entity shall collect, maintain and, upon completion of the Project, provide the information indicated in Attachment V of this A�'eement, to the Commissioner of NIMB. The information must include, but is not limited to, the followin�: the number and types of jobs created by the Project, whether the jobs are new or retained, where the jobs are located and the pay ran�es of the jobs. Section 7.31 Additional Requirements. The Public Entity anci the State Entity a�ree to comply with the following additionat requirements. In the event of any conflict or inconsistency bet�,veen the following additional requirements and any other provisions or requirement contained in this A�reement, the follo�ving additional requirements contained in this Section shall control.
