of a number of amendments to items related to motor freight terminals. While the <br />ЊЉЋ <br />Planning Division staff agrees there are additional areas concerning outdoor storage, <br />ЊЉЌ <br />semi-trailers, motor vehicles, and motor freight terminals, which require further <br />ЊЉЍ <br />consideration and possible amendment, these items are not a component of the <br />ЊЉЎ <br />published/notices public hearing. Therefore, a separate public hearing on these and <br />ЊЉЏ <br />other items the Planning Division has identified could be addressed as early as January <br />ЊЉА <br />2017. <br />ЊЉБ <br />There are, however, two items related to the proposal that the representative of Koch <br />ЊЉВ <br />Trucking would like the Planning Commission to consider. They include the following: <br />ЊЊЉ <br />To include “primary” before public street in line 82-83 (above – criteria 37 a) so as to <br />ЊЊЊ <br />identify which public street would be used in determining trailer parking; and <br />ЊЊЋ <br />To reduce the side/rear setback in line 85-86 (above – criteria 37 b) from the <br />ЊЊЌ <br />proposed 10 feet to five feet in order to be consistent with the established parking lot <br />ЊЊЍ <br />setback in Section 1006.05.C (Table 1006-3) of the Zoning Code. <br />ЊЊЎ <br />In the case of outdoor storage, specifically semi-trailers, the Planning Division is <br />ЊЊЏ <br />opposed to allowing semi-trailers or other items adjacent to the public street. In 2009, <br />ЊЊА <br />when the City was rewriting the Zoning Code, it discussed at length ancillary or <br />ЊЊБ <br />accessory use and the appropriate location for such items on a site. It was deemed such <br />ЊЊВ <br />items should be located in rear yard areas or side yards, but not in front of a primary or <br />ЊЋЉ <br />principle building. The 2010 Zoning Ordinance also established new design standards <br />ЊЋЊ <br />for building and parking placement on a property and a property at two intersecting <br />ЊЋЋ <br />streets or a corner lot. Parking is allowed between the building and the public street, <br />ЊЋЌ <br />but this parking is employee or customer and not to be used for outdoor storage. <br />ЊЋЍ <br />Supporting the proposed change would conflict with existing Design Standards and the <br />ЊЋЎ <br />regulations covering various types of outdoor storage. <br />ЊЋЏ <br />While the Planning staff understands, in certain instances, the need or desire to be <br />ЊЋА <br />consistent or even clear, the established setback is tied directly to a parking lot, not <br />ЊЋБ <br />specifically parking of vehicles. In the case of semi-trailers and their potential as a fire <br />ЊЋВ <br />hazard, the Fire Chief has indicated his preference for a 10 foot setback from a side and <br />ЊЌЉ <br />rear yard property line to add distance between the semi-trailers and other building, <br />ЊЌЊ <br />vehicles, or semi-trailers on an abutting property. Planning staff supports the proposal <br />ЊЌЋ <br />as written. <br />ЊЌЌ <br />Please note - there are difficulties or challenges in most all code amendment because <br />ЊЌЍ <br />they cannot be designed to fit every situation. Regarding these specific amendment <br />ЊЌЎ <br />before the Planning Commission, the Planning Division has considered the proposed <br />ЊЌЏ <br />text amendments from a holistic perspective and not from a site specific perspective. <br />ЊЌА <br />SPCA <br />ЊЌБ <br />UGGESTEDLANNING OMMISSION CTION <br />Based on the project report, public comments, and Planning Commissioner input, <br />ЊЌВ <br />consider approval of the amendments to Table 1006-1 and §1009.02, adding motor <br />ЊЍЉ <br />freight terminal as a conditional use in the Industrial District. <br />ЊЍЊ <br /> <br />
