<br />CHAPTER 905 <br />SWIMMING POOLS <br /> <br />905.01: PERMIT REQUIRED: <br /> <br />A building permit shall be required for any swimming pool with a capacity over one <br />thousand (1,000) gallons or with a depth of over three feet (3') of water. The permit fee <br />shall be as listed in the most current Fees Resolution adopted by the City Council.(Ord. <br />636, 11-9-70) <br /> <br />905.02: APPLICATION: <br /> <br />An application for a building permit shall show: <br /> <br />A. The type and size of pool. <br /> <br />B. A site plan indicating the location of the pool; location of house, garage, fencing and <br />other improvements on the lot; location of structures on all adjacent lots; location of <br />filter unit, pump and wiring indicating the type of such units; location of backflush <br />and drainage outlets; grading plan, fInished elevations and fmal treatment (decking, <br />landscaping, etc.) around the pool; location of existing overhead or underground <br />wiring, utility easements, trees and similar features, location of any water heating <br />unit. (Ord. 636, 11-9-70) <br /> <br />905.03: CONDIDONS: <br /> <br />A. Location in Yard: Pool shall not be located within ten feet (10) of any side or rear lot <br />line nor within six feet (6) of any principal structure (except decks) or frost footing. <br />Pools shall not be located within any required front yard. <br /> <br />B. Utility Lines: Pools shall not be located beneath overhead utility lines nor over <br />underground utility lines, nor located within any private or public utility, walkway, <br />drainage or other easement. <br /> <br />C. Inground Pools: In the case of inground pools, necessary precautions shall be taken <br />during construction to: <br /> <br />1. Avoid damage, hazards or inconvenience to nearby or adjacent property. <br /> <br />2. Assure that proper care shall be taken in stockpiling excavated material to avoid <br />erosion, dust or other infringements upon adjacent property. <br /> <br />D. Access for Construction: All access for construction shall be over the owner's land <br />and due care shall be taken to avoid damage to public streets and adjacent private or <br />public property. <br /> <br />12 <br />
