<br />ORDINANCE NO. 1296 <br /> <br />AN ORDINANCE AMENDING TITLE 11, SECTIONS 1102, Subsection 1102.1 E through G <br />PERTAINING TO REQUIRED PUBLIC HEARINGS ON FINAL PLATS <br /> <br />THE CITY OF ROSEVILLE ORDAINS: <br /> <br />SECTION 1. Purpose. The Roseville City Code, Title 11, Sections 1102.01 E through G is hereby <br />amended by revising language regarding required public hearings. Minnesota State Statutes 462.358 and City <br />Code Section 1102.01, E through G require that a public hearing must be held on subdivisions at the time that <br />preliminary plat approval is requested. Section 108 of the City Code requires such hearings be held by the Planning <br />Commission. The Statues do not require a public hearing prior to final approvals by the City Council. This <br />ordinance makes the City Code consistent with the State Statutes by deleting a required second public hearing prior <br />to final approval. <br /> <br />SECTION 2. Section 1102.01, E through G is hereby amended as follows: <br /> <br />E. Action By The City Council: (on preliminary plats) <br /> <br />1. The recommendation of the Planning Commission on the preliminary plat shall be considered by the City <br />Council, and the City Council shall approve or disapprove the plan within sixty (60) days after the application <br />was accepted as complete or such date as extended by the applicant or City Council. If the City Council shall <br />disapprove said preliminary plat, the grounds for any such refusal shall be set forth in the proceedings of the <br />City Council and reported to the person or persons applying for such approval. (Ord. 1176, 11-25-1996) <br /> <br />2. Approval of the preliminary plat shall not be construed to be approval of the final plat. (1990 Code; 1995 <br />Code) <br /> <br />F. Final Plat: <br /> <br />1. Final Plat Submission: After approval of the preliminary plat by the City Council, the owner or subdivider <br />shall, within sixty (60) days thereafter, submit to the City a new application for final plat approval. Unless <br />given a time extension, the failure to submit a complete application for final plat approval within the sixty (60) <br />day period, shall nullify the approval of the preliminary plat. In such case the applicant may reapply for <br />preliminary plat approval. (Ord. 1176, 11-25-1996) <br /> <br />2. Required Changes Incorporated: The final plat shall have incorporated all changes or modifications required <br />by the City Council; in all other respects it shall conform to the preliminary plat. It may constitute only that <br />portion of the approved preliminary plat which the subdivider proposes to record and develop at the time, <br />provided that such portion conforms with all the requirements of this Title. (1990 Code; 1995 Code) <br /> <br />G. Approval or Rejection: The City Council may approve or disapprove the final plat. Such approval or <br />disapproval shall be given not more than sixty (60) days after the filing of the final plat, with a formal request <br />for approval. The grounds for any refusal to approve the plat shall be set forth in the proceedings of the City <br />Council and reported to the person or persons applying for such approval. (1990 Code; 1995 Code) <br /> <br />SECTION 3. Effective Date. This ordinance amendment to the City Code shall take effect upon <br />J\<;¡ssage and publication. <br /> <br />Passed this 20th day of October, 2003 <br />
