EXTRACT OF MINUTES OF MEETING <br /> OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br /> Roseville, Minnesota was duly held on the 15th day of May, 2017, at 6:00 p.m. <br /> The following members were present: Willmus, Laliberte, Etten, McGehee, and Mayor Roe, and <br /> the following were absent: none. <br /> Member Willmus introduced the following resolution and moved its adoption: <br /> RESOLUTION No. 11419 <br /> RESOLUTION OPPOSING THE PROPOSED LEGISLATION REGARDING <br /> UNREGULATED ACCESS TO THE PUBLIC RIGHT-OF-WAY FOR INSTALLATION <br /> OF SMALL CELL WIRELESS EQUIPMENT AND ANTENNA SYSTEMS <br /> WHEREAS, the City of Roseville has regulations and provisions contained in Chapter 707 of the <br /> City's City Code detailing the City's permitting of use of the public right-of-way; and <br /> WHEREAS, legislation was proposed in the Minnesota Legislature that would allow wireless <br /> companies to install small cell facility networks in public rights-of-way, subject to mandated <br /> statutory regulation that materially differs from the regulation of all other right-of-way users and <br /> significantly limits local authority to regulate facility placement issues within the public right-of- <br /> way; and <br /> WHEREAS, granting such access to the public right-of-way by wireless companies is <br /> unnecessary, competitively unfair and discriminatory, and may result in new wireless installations <br /> in public rights-of-way that compromise public safety and other public interests; and <br /> WHEREAS, the City of Roseville currently receives some form of compensation for installations <br /> or attachments on City owned facilities and the public's right to compensation for use of its <br /> assets may be compromised with the passing of the proposed legislation; and <br /> WHEREAS, the legislation would supersede existing right-of-way and zoning ordinances and <br /> comprehensive plans applicable to new wireless installations in public rights-of-way that the City <br /> of Roseville has enacted and planned over the years. <br /> NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Roseville, <br /> Minnesota that the City of Roseville does hereby oppose legislation granting unfair and <br /> discriminatory access to the public rights-of-way for the installation of small cell wireless <br /> equipment and antenna systems. <br />
