<br />ORDINANCE No. 1302 <br /> <br />AN ORDINANCE AMENDING TITLE 10, SECTION 1011, Subsection 1011.01 through <br />1011.05 PERTAINING TO NONCONFORMING USES AND STRUCTURES AND <br />DEFINTIONS (SECTION 1002.02) <br /> <br />THE CITY OF ROSEVILLE ORDAINS: <br /> <br />SECTION 1. Purpose. The Roseville City Code, Title 10, Sections 1011.01 through <br />1011.05 and Section 1002.02 are hereby amended by revising language regarding <br />nonconforming uses and structures to provide more clarity and ease of use of this section. <br /> <br />SECTION 2. Section 1002.02 (Definition of "Nonconforming Structure") is hereby <br />amended as follows: <br /> <br />NONCONFORMING USE OR STRUCTURE: A nonconfonning use or structure is <br />any use, placement, or arrangement of land and/or structures legally existing prior to the <br />enactment of a Code provision prohibiting such use or structure. <br /> <br />SECTION 3. CHAPTER 1011 and Section 1011 (Title) is hereby amended to read as <br />follows: <br /> <br />CHAPTER 1011 <br />NONFORMING USES AND STRUCTURES <br /> <br />SECTION 4. Section 1011, subsections 1011.01 through 1011.05 are hereby <br />amended as follows: <br /> <br />1011.01: DEFINITION: <br /> <br />A nonconfonning use or structure. See definition in Section 1002.02. <br /> <br />1011.02: EXISTING STRUCTURES OR USES: <br /> <br />A. A pre-existing nonconfonning use or structure may be continued but may not be extended, <br />expanded, intensified or changed, unless to a confonning use. Exceptions include: <br /> <br />1. An expansion of a pre-existing residential principal or accessory structure in an R-l or <br />R-2 zoning district which maintains the same property line setbacks and structure <br />separations provided there is no further encroachment of any non-confonning structural <br />dimension or increase in the non-confonnity of use ofthe land. <br /> <br />2. A pre-existing principal or accessory structure, including expansion thereof, in which a <br />property line setback dimension has been made substandard by eminent domain or other <br />fonnal public agency action.
