recorded by the Office of the Ramsey County Registrar of Titles on February 11, 1964, as <br /> Document No. 467467, and recorded by the Office of the Ramsey County Recorder on February <br /> 11, 1964, as Document No. 1611416; and <br /> WHEREAS, the Vacation Resolution indicates that the portion of Eldridge Avenue, a <br /> public street, lying between the 2095 Property and the 2105 Property, was vacated pursuant to a <br /> petition from adjoining property owners; and <br /> WHEREAS, the Vacation Resolution did not specifically reserve for the City an <br /> easement for utilities in the vacated street on the 2095 Property and the 2105 Property; and <br /> WHEREAS, the City allowed the Owners to construct a driveway over the vacated street <br /> on the 2095 Property and the 2105 Property(the"Driveway"); and <br /> WHEREAS, the 2095 Owners and the 2105 Owners agreed to construct and maintain the <br /> Driveway, sharing the costs equally, in an agreement dated December 30, 1963, recorded by the <br /> Office of the Ramsey County Registrar of Titles on February 11, 1964, as Document No. <br /> 467468, and recorded by the Office of the Ramsey County Recorder on February 11, 1964, as <br /> Document No. 1611417 (the"Shared Driveway Agreement"); and <br /> WHEREAS, the City needs access to the underground utilities located beneath the <br /> Driveway on the 2095 Property and the 2105 Property; and <br /> WHEREAS, the parties cannot ascertain whether a utility easement on the 2095 Property <br /> and the 2105 Property was documented or otherwise obtained by the City; and <br /> WHEREAS, the Owners desire to maintain and repair the Driveway for the benefit of <br /> their respective properties; and <br /> WHEREAS, the City desires to maintain and repair the utilities, including a sewer pipe, <br /> buried beneath the Driveway; and <br /> 2 <br />
