I <br /> i <br /> I <br /> 10.21 Wells, Seller does not know of any "wells" on the described Property within the meaning of <br /> Minnesota Statutes section 1031.This representation is intended to satisfy the requirements of that statute, <br /> 10.22 Storage Tanks. No "aboveground storage tanks" or "underground tanks" (within the meaning of <br /> Minnesota Statutes section 116,46) are located in or about the Property, except such storage tanks that have been <br /> duty registered with all appropriate regulatory and governmental bodies and otherwise are in compliance with <br /> applicable federal, state, and local statutes, regulations, ordinances and other regulatory requirements. During <br /> Seller's ownership of the Property, Seller has no actual knowledge of any aboveground storage tanks or <br /> underground tanks that have been removed or filled, <br /> 10.23 Subsurface Sewage Treatment Systems,Seller does not know of any subsurface sewage treatment <br /> systems located on or serving the Property or any part thereof, which representation is intended to satisfy the <br /> requirements of Minnesota Statutes section 115.55, subdivision 6. Seller certifies that sewage generated on the <br /> Property goes to a facility permitted by the Minnesota Pollution Control Agency, <br /> 10.24 Methamphetamine Production. For the put-poses of satisfying any applicable requirements of <br /> Minnesota Statutes section 152,0275, Seller discloses and certifies that, to its knowledge, methamphetamine <br /> production has not occurred on the Property. <br /> 10.25 Airport Zoning,For the purposes of satisfying any applicable requirements of Minnesota Statutes <br /> section 360.065, Seller discloses that the Property is not affected by airport zoning regulations. <br /> 10.26Intentionally deleted. <br /> 10.27 Wetlands. To die best of Setter's knowledge,there does not exist on the Property any portion of a <br /> wetland,watercourse,water body,flood plain or shore land district,or tideland or coastal zone,which is regulated by <br /> the Army Corps of Engineers, the Minnesota Department of Natural Resources or any other federal, state or local <br /> govenunental agency under any Environmental Law. <br /> 10.28 Prorations. The information to be furnished by Seller on which the computation of prorations is <br /> based will be true,correct and complete in all material respects. <br /> 10.29 Warranties. The Warranties made available to Buyer pursuant to Section 4,1, if any, are <br /> complete and accurate and are in full force and effect in accordance with their respective terns, <br /> 10.30 No Litigation. Seller has not received notice of(a)any actual or pending litigation or proceeding by <br /> any organization,person,individual or governmental agency against Seller with respect to the Property or against the <br /> Property, (b) any violation of the Property's compliance with applicable fire or life safety laws, building code <br /> ordinances, zoning ordinances or any similar statutes, ordinances, laws,rules, or regulations, or (c)any condition, <br /> defect or inadequacy which, if not corrected, would result in the termination of,or increase in the cost of,insurance <br /> coverage, <br /> 10,31 Boundary Lines of Land.There is no pending litigation and Seller has no knowledge nor has Seller <br /> received notice of any dispute concerning the location of the lines and corners of the Land,and Seller has not been <br /> served with any legal action concerning the location of the lines and corners of the Land, <br /> 10.32 Miscellaneous. It is a condition of Closing that the representations and warranties contained in <br /> this Section 10 are true and correct at Closing and Seller will reaffirm these representations and warranties at <br /> Closing in the Bring-Down Certificate required by Section 5.1.9, In the event that Seller or Buyer learns that any <br /> of said representations or warranties becomes inaccurate between the Contract Date and the Closing Date, <br /> Page 20 of 38 <br />
