information and the citv provides written notice of <br />incompleteness to the applicant within 30 days of <br />receipt the application. Upon submission of additional <br />documents or information, the citv shall have ten days <br />to notifv the applicant in writing of anv still -missing <br />information. <br />.1, The city and a small wireless facility applicant agree in <br />writing to toll the review period. <br />B. Conditions: The Director may impose reasonable conditions upon the issuance of the <br />permit and the performance of the applicant thereunder to protect the public health, <br />safety and welfare or when necessary to protect the right of way and its current use. <br />(Ord. 1209, 8-24-1998) <br />C. Small Wireless Facilitv Conditions. In addition to other conditions of section 28-103. the <br />erection or installation of a wireless support structure, the collocation of a small wireless <br />facility, or other installation of a small wireless facilitv in the right-of-wav, shall be <br />subject to the following conditions: <br />A small wireless facilitv shall onlv be installed under those attachment <br />specifications and at the height indicated in the detail plans attached to the <br />approved permit. Permittee may not change the number. kind or location of <br />attachments authorized under a permit without the prior written consent of the <br />citv. Anv expansion shall require a new permit. <br />A permittee shall have the authority to act on behalf of a wireless service <br />provider and provide evidence of the same. subject to the review and approval <br />of the city, upon demand of the citv. <br />Citv shall retain exclusive and priority use of citv infrastructure used for <br />collocation. The city retains complete discretion as to use of city <br />infrastructure. including requests for collocation or modification, except as <br />pursuant to State or Federal laws. This chapter does not require the citv to <br />replace. upgrade. or alter existing citv infrastructure for collocation.Where an <br />applicant proposes to replace a wireless support structure, the city may <br />impose reasonable restocking, replacement. or relocation requirements on the <br />replacement of such structure. At the time of issuance of permit, vermitee <br />shall enter into a collocation agreement as required by Section 28- 103(e). <br />City retains the right to remove any attachment if necessary to protect public <br />safety or prevent imminent damage to city infrastructure. <br />Wireless facility shall be removed or relocated at permittee"s sole expense and <br />in timelv manner pursuant to written city request. Small wireless facilitv permit <br />shall be automaticallv terminated and wireless support structure removed should <br />the wireless facility not be continuously operated and maintained for a period of <br />six months. Permittee may not transfer, assign, or convev small wireless facility <br />permit without the consent of citv. <br />No wireless support structure installed within the right-of-wav following Mav <br />17. 2017 shall exceed 50 feet in height without the city"s written authorization, <br />
