Regular City Council Meeting <br /> Monday, February 26, 2018 <br /> Page 11 <br /> Board Member McGehee added that there seems to be an argument that if it is not specif- <br /> ically excluded, it is okay. That is not the way a PUD works. Rather, it is very specific <br /> in what is allowed. <br /> Chair Roe added that where there is a use that comes down the road that had not been an- <br /> ticipated by a table, usually Cities have to do is attempt to match the new use that has <br /> never been seen before with something that is in the table. His understanding is that if a <br /> use is not listed as being able to being done in that zone, it is not permitted. He pointed <br /> out that referring to the B-4 zoning chart that was in effect at the time of the PUD (which <br /> is Attachment 0), laboratories, medical and dental research is not listed as a permitted <br /> use. Several different types of research facilities are not permitted. There is no type of <br /> educational uses that are permitted in the B-4 zone. There was one mention under <br /> churches/public private colleges, but it is not listed as permitted in the table. <br /> Chair Roe continued that if the argument is that B-4 covers and applies, then he does not <br /> see how referring to the underlying B-4 uses can get in the educational aspect to this. <br /> There are two pieces to the educational part: classroom space and laboratory space. <br /> There might be more of an argument on the laboratory space. Classroom space means <br /> education, and there is no provision for educational space. He recalled he was supportive <br /> of the PUD amendment back when this was applied for, and he wishes this use could take <br /> place in this space. However, he is tasked with the interpretation of the codes and re- <br /> quirements that were in.place. Additionally,he does not think it would be appropriate to <br /> use definitions in the 2010 zoning code to attempt to analyze what was happening in the <br /> earlier zoning code that was part of the context of the PUD at the time. <br /> Roll Call <br /> Ayes: McGehee, Willmus, Etten, and Roe. <br /> Nays: Laliberte. <br /> Motion carried. <br /> 12.
