1 <br /> l <br /> bill message notice in advance of the channel launch in the interests of launching the <br /> channel sooner. <br /> 2. Remote Cablecasting. Grantee shall provide at no charge to the City/Commission <br /> for the term of this Franchise and until it renews, three (3) "open" cable internet modems with a <br /> static IP addresses that can be connected and operational anywhere on the System and capable of <br /> transmitting live remote HD PEG programming to the City's master control center for live <br /> cablecasting, using business-class internet service (currently 50 mbs download and 10 mbs <br /> upload) and three MPEG encoder/transmitters and one multi-channel receiver device (capable of <br /> receiving at least 3 remote video feeds) for the Commission's Master Control. <br /> 3. PEG Streaming. Grantee agrees to include the PEG channels in its in-home <br /> streaming cable service application (currently Xfinity TV App). Grantee will use reasonable <br /> efforts to make the PEG channels available to Subscribers outside the home on its TV-TO-GO <br /> Application, or equivalent. <br /> 4. Equipment. In the event Grantee makes any change in the Cable System and <br /> related equipment and facilities or in its signal delivery technology, which requires the City or <br /> Commission to obtain new equipment in order to be compatible with such change for purposes <br /> of transport and delivery of the Access Channels to the Grantee's headend, Grantee shall, at its <br /> own expense and free of charge to the City, the Commission, or its designated entities, purchase <br /> such equipment as may be necessary to facilitate the cablecasting of the PEG Channels in <br /> accordance with the requirements of the Franchise. <br /> 5. Grantee Not Liable. Neither the Grantee nor the officers, directors, or employees <br /> of the Grantee is liable for any penalties or damages arising from programming content not <br /> originating from or produced by the Grantee and shown on any public access channel, education <br /> access channel, government access channel, leased access channel, or regional channel. <br /> 6. Charges for Use. There shall be no charge to the City for the use of the PEG <br /> Channels. <br /> 7. Access Rules. City, or its designee, shall implement rules for use of any access <br /> channel(s). <br /> 8. Access Support. <br /> a. In addition to satisfying the other requirements of this Section,the Grantee <br /> is required to provide the following additional PEG use funding(as used in this Section), <br /> PEG access refers to the channels, facilities and equipment used in connection with the <br /> channels on the subscriber network and associated interconnections; PEG use includes <br /> PEG access and dark fiber network and PRISMA network use, including use in <br /> connection with the network provided pursuant to Section 7.2 (Additional Network <br /> Services)including Exhibit C: <br /> 18 <br />
