REQUEST FOR COUNCIL ACTION <br /> Date: January 11, 2016 <br /> Item No.: 8.e <br />Department Approval City Manager Approval <br />Item Description: Kath Properties, LLC Redevelopment – Public Improvement Contract <br />Approval <br />B <br />ACKGROUND <br />1 <br />The existing gas station at 2645 County Road C is looking at redeveloping the site. As part of the <br />2 <br />development plans for the site, the existing sanitary sewer line running through the site needs to <br />3 <br />be relocated. This sanitary sewer line was relocated once previously when the gas station was <br />4 <br />built in the 1980’s. When the sewer was relocated the City acquired a new easement and a new <br />5 <br />sewer was installed by the developer at that time. <br />6 <br />D <br />ISCUSSION <br />7 <br />The developer, Kath Properties LLC, has worked with the City to develop the Public <br />8 <br />Improvement Contact for the relocation of the sanitary sewer running through the parcel. <br />9 <br />Some of the key provisions of the contract include; <br />10 <br />The public improvements would consist of new sanitary sewer pipe and manholes in a <br />11 <br />new alignment through the parcel <br />12 <br />All work would be done through the developer’s contractor. <br />o <br />13 <br />All costs for the improvements would be paid by the developer. <br />14 <br />The estimated cost of construction is $171,270.00 <br />o <br />15 <br />The developer will provide a financial security in the amount of 125% of the <br />o <br />16 <br />estimated cost of construction ($214,087.50) in the event the developer fails to <br />17 <br />perform. <br />18 <br />The City would provide oversite on the construction. <br />19 <br />The Developer will pay the City $6,850.80 for these inspection services. <br />o <br />20 <br />The developer will provide a new easement for the new sanitary sewer alignment. <br />21 <br />The existing sanitary sewer easement will be vacated at a later date. <br />o <br />22 <br />The improvement is set to be started by August 1, 2016. <br />23 <br />The attached contract has been reviewed by the City Attorney. <br />24 <br />Outside of the Public Improvement Contract, this redevelopment project has not formally been <br />25 <br />reviewed or approved by the City, Ramsey County, the watershed or the Minnesota Department <br />26 <br />of Transportation.
