1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />PUBLIC IMPROVEMENT CONTRACT <br />11 <br />KATH PROPERTIES,LLC REDEVELOPMENT <br />12 <br />13 <br />14 <br />Parties. <br />I. This Agreement, dated ____________, 2016, is entered into between the City of Roseville, <br />15 <br />a Minnesota municipal corporation, whose address is 2660 Civic Center Drive, Roseville, Minnesota <br />16 <br />City <br />55113 (“the ”), and Kath Properties,LLC, a Minnesota limited liability company, whose <br />17 <br />address is 3096 Rice Street, Little Canada, Minnesota 55113 (“DEVELOPER”). <br />18 <br />Request for Public Improvement approval. <br />II.The Developer has asked the City to approve a public <br />19 <br />infrastructure improvement on the site legally described as follows: <br />20 <br />LOT 4, BLOCK1, SLAWIK PARK ADDITION NO. 3, <br />21 <br />Ramsey County, Minnesota (the “PROPERTY”) <br />22 <br />23 <br />Terms and Conditions of Public Improvement Approval. <br />III. For good and valuable consideration, <br />24 <br />the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows: <br />25 <br />Public Improvements. <br />A. The Developer shall, subject to the terms and conditions contained herein, <br />26 <br />perform the following work and construct the following improvements (“Public Improvements”) in <br />27 <br />compliance with City approved Plans described in Section III B below and all rules, regulations, <br />28 <br />standards and ordinances of the City: <br />29 <br />1.Sanitary sewer construction: The Developer shall construct the new sanitary sewer and <br />30 <br />remove the existing sanitary sewer. <br />31 <br />a)All sanitary sewers shall be constructed in accordance with City details, <br />32 <br />specifications, and the City approved Public Improvement Construction Plans. <br />33 <br />b)The DEVELOPER shall convey autility easement to the City for the new sanitary <br />34 <br />sewer alignment legally described in Exhibit A. <br />35 <br />2.Erosion control. Prior to the commencement of any grading and before any utility <br />36 <br />construction is commenced or building permits are issued, the Developer must obtain a <br />37 <br />City Erosion Control Permit for the site. The Developer shall meet all requirements of the <br />38 <br />City’s Erosion Control Ordinance including but not limited to the following. <br />39 <br />a)No construction activity shall be allowed and no building permits shall be issued <br />40 <br />unless the Property is in full compliance with the erosion control requirements. <br />41 <br />b)Measures shall be installed in compliance with MPCA NPDES permit requirements. <br />42 <br />Page 1 of 11 <br /> <br />
