REQUEST FOR COUNCIL ACTION Date: January 11, 2016 Item No.: 8.f Department Approval City Manager Approval Item Description: Resolution Authorizing the City to Enter into a Limited Use Permit for a Sidewalk on Lexington Ave within the right-of-way Trunk Highway 36 B ACKGROUND 1 th On August 24 the City Council approved a Cooperative Construction Agreement with the 2 Minnesota Department of Transportation (MnDOT) for the replacement of the Trunk Highway 36 3 bridge over Lexington Ave. The project will replace the existing bridge with two new bridges (one 4 for eastbound TH 36 and one for westbound TH 36), reconstruct the on and off ramps, and replace 5 the traffic signal systems at the two ramp intersections. A new sidewalk will also be constructed 6 between the two ramps on the east side of Lexington Ave. Finally, significant stormwater devices 7 will be constructed to meet watershed requirements and help with some historic flooding issues in 8 the area. 9 In order to construct the sidewalk along the east of Lexington Avenue, MnDOT requires the City to 10 enter into a Limited Use Permit for the sidewalk within the state highway right-of-way. This permit 11 simply establishes the fact that the sidewalk is there by permit and, in the future, if MnDOT needed 12 to modify or move the sidewalk there would be no declared environmental impacts as outlined in 13 federal regulations and commonly referred to as Section 4(f) impacts. These regulations require that 14 impacts to resources outlined in this section, including “park and recreational lands,” which a trail or 15 sidewalk could be categorized, would need to be avoided and/or mitigated. 16 MnDOT will construct the sidewalk as part of the overall project. Ramsey County and the City of 17 Roseville will split the cost of the sidewalk 50/50. The City will be responsible for minor and major 18 maintenance of the sidewalk including snow removal. These details were outlined in the previously 19 approved Cooperative Construction Agreement. 20 FI INANCIALMPACTS 21 There is no cost to the City for the execution of the Limited Use Permit. The City’s share of the 22 construction of the sidewalk is $22,444. 56 which will be funded using Municipal State Aid finds. 23 SR TAFF ECOMMENDATION 24 Staff recommends the Council approve the attached resolution authorizing the City to enter into a 25 Limited Use Permit for a sidewalk along Lexington Ave within the right-of-way of Trunk Highway 26 36. 27 Page 1 of 2
