REQUEST FOR COUNCIL ACTION <br /> Date: January 11, 2016 <br /> Item No.: 8.f <br />Department Approval City Manager Approval <br />Item Description: Resolution Authorizing the City to Enter into a Limited Use Permit for a <br />Sidewalk on Lexington Ave within the right-of-way Trunk Highway 36 <br />B <br />ACKGROUND <br />1 <br />th <br />On August 24 the City Council approved a Cooperative Construction Agreement with the <br />2 <br />Minnesota Department of Transportation (MnDOT) for the replacement of the Trunk Highway 36 <br />3 <br />bridge over Lexington Ave. The project will replace the existing bridge with two new bridges (one <br />4 <br />for eastbound TH 36 and one for westbound TH 36), reconstruct the on and off ramps, and replace <br />5 <br />the traffic signal systems at the two ramp intersections. A new sidewalk will also be constructed <br />6 <br />between the two ramps on the east side of Lexington Ave. Finally, significant stormwater devices <br />7 <br />will be constructed to meet watershed requirements and help with some historic flooding issues in <br />8 <br />the area. <br />9 <br />In order to construct the sidewalk along the east of Lexington Avenue, MnDOT requires the City to <br />10 <br />enter into a Limited Use Permit for the sidewalk within the state highway right-of-way. This permit <br />11 <br />simply establishes the fact that the sidewalk is there by permit and, in the future, if MnDOT needed <br />12 <br />to modify or move the sidewalk there would be no declared environmental impacts as outlined in <br />13 <br />federal regulations and commonly referred to as Section 4(f) impacts. These regulations require that <br />14 <br />impacts to resources outlined in this section, including “park and recreational lands,” which a trail or <br />15 <br />sidewalk could be categorized, would need to be avoided and/or mitigated. <br />16 <br />MnDOT will construct the sidewalk as part of the overall project. Ramsey County and the City of <br />17 <br />Roseville will split the cost of the sidewalk 50/50. The City will be responsible for minor and major <br />18 <br />maintenance of the sidewalk including snow removal. These details were outlined in the previously <br />19 <br />approved Cooperative Construction Agreement. <br />20 <br />FI <br />INANCIALMPACTS <br />21 <br />There is no cost to the City for the execution of the Limited Use Permit. The City’s share of the <br />22 <br />construction of the sidewalk is $22,444. 56 which will be funded using Municipal State Aid finds. <br />23 <br />SR <br />TAFF ECOMMENDATION <br />24 <br />Staff recommends the Council approve the attached resolution authorizing the City to enter into a <br />25 <br />Limited Use Permit for a sidewalk along Lexington Ave within the right-of-way of Trunk Highway <br />26 <br />36. <br />27 <br />Page 1 of 2 <br /> <br />
