B. Multiple Residential Dwellings and Commercial Establishments: Containers shall be located in a <br /> place determined by the pertinent Licensee and Complex owner or manager, and said containers <br /> shall be located out of the public view. (Ord. 1098, 8-12-1991) (Ord. 1280, 03-31-2003) <br /> 403.13: RECYCLING FEE: <br /> A. Fee: All Residential Dwellings and Multi Family Complexes Multiple Residential Dwellings shall <br /> pay a recycling fee. The fee shall be charged quarterly as part of the City utility bill and shall be <br /> due along with the utility bill. The fee shall be as prescribed from time to time by City Council <br /> resolution. (Ord. 1280, 03-31-2003) <br /> B. Penalty: Each quarterly billing for a recycling fee not paid when due shall incur a penalty charge of <br /> 10%of the amount past due. <br /> C. Action to Collect: Any amount due, including penalties, for recycling fee in excess of 90 days past <br /> due on October 1 of any year shall be certified to the County Auditor for collection with real estate <br /> taxes in the following year. (Ord. 1098, 8-12-1991) <br /> 403.14: EXISTING AGREEMENT: <br /> If any Multi Family Complex Multiple Residential Dwelling in the City on the date of adoption of this <br /> ordinance has in place a valid contract with a private recycling contractor that provides for recycling of <br /> all Targeted Recyclables,then,upon proof of the existence of the contract, the Multi Family Complex <br /> Multiple Residential Dwelling is exempt from participation in the City recycling program and the fee in <br /> Section 403.13,provided 1) the contract remains in force, and 2)the private recycling contractor meets <br /> all the requirements in this Chapter. In no event shall the exemption extend beyond December 31, <br /> 2007, at which time all Multi Family Complexes Multiple Residential Dwellings shall be covered <br /> hereunder.
