(Ord. 1424 02-13-12) (Ord. 1455, 10-21-13) <br /> TOBACCO-RELATED DEVICE: Any pipe, rolling papers, or other device intentionally <br /> designed or intended to be used with tobacco products. Tobacco-related device includes <br /> components of tobacco-related devices which may be marketed or sold separately. <br /> VENDING MACHINE: Any mechanical, electric or electronic, or other type of device <br /> that dispenses tobacco products upon the insertion of money, tokens or other form of <br /> payment directly into the machine by the person seeking to purchase the licensed product. <br /> 306.03 LICENSE REQUIRED: <br /> No person shall keep for retail sale, sell, or offer to sell at retail any tobacco product as <br /> defined in this Chapter without first having obtained a license to do so from the city. (Ord. <br /> 1133, 1-24-94) <br /> 306.04 APPLICATION: <br /> The application for a license to sell tobacco products shall state the full name and address of <br /> the applicant, the location of the building and the part to be used by the applicant under the <br /> license, the kind of business conducted at such location and such other information as shall <br /> be required by the application form. (Ord. 1133, 1-24-94) <br /> 306.05 PROHIBITED SALES: <br /> a. No person shall sell, offer to sell or give away any tobacco related product to any <br /> person under the age of 21 years. <br /> b. No person shall sell or dispense any tobacco product through the use of a vending <br /> machine. <br /> c. No person shall allow the sale of tobacco products by self-service merchandizing <br /> whereby the customer may have access to those products without having to request <br /> the products from the licensee or licensee's employee and whereby there is not a <br /> physical exchange of the tobacco product between the licensee or licensee's <br /> employee and the customer. All tobacco products must be stored behind the sales <br /> counter or other area not freely accessible to customers, or in a case or other storage <br /> unit not left open and accessible to the general public. (Ord. 1133, 1-24-94) <br /> Provided,however, the requirements of this section shall not apply to establishments <br /> which: <br /> 1. Prohibit persons under 21 years of age from entering the establishment at all <br /> times; <br /> 2. Post notice advising of the prohibition at all entrances to the establishment; <br /> and <br /> 3. Derive at least 90 percent of their revenues from the sale of tobacco and <br /> tobacco-related products. <br /> 306.06 INDOOR SMOKING PROHIBITED: <br /> Smoking is prohibited within the indoor area of any retail establishment licensed under this <br />
