Approve Presumptive Penalty for Chipotle Alcohol Compliance Failure <br /> Lt. Scheider briefly reviewed this request, recommending approval as detailed in <br /> the RCA. A Chipotle employee sold alcohol to a 17-year-old underage compli- <br /> ance checker. The employee stated she did not look carefully at the driver's li- <br /> cense. She no longer works for the establishment and is contesting the$250 pen- <br /> alty in court. <br /> Lt. Scheider stated the on-sale ordinance provides for a 1-day suspension and a <br /> $1,000 fine of the establishment. <br /> Councilmember McGehee asked whether there is anything less onerous for the <br /> City than pursuing the $250 fee against the individual who sold the alcohol, as it <br /> creates a lot of work for staff. <br /> Mayor Roe pointed out that the violation is against an individual who is entitled to <br /> due process and cannot be passed on to the establishment. <br /> Mayor Roe offered an opportunity for public comment, with no one coming for- <br /> ward. <br /> Willmus moved, Etten seconded, approval to allow the Roseville Police Depart- <br /> ment to issue and administer the presumptive penalty as set forth in Section <br /> 302.15, of the Roseville City Code or other action as determined by the Roseville <br /> City Council. <br /> Roll Call <br /> Ayes: Willmus, Laliberte, Etten, McGehee and Roe. <br /> Nays: None. <br /> h.
