Based upon <br /> the existing criteria contained'in <br /> §1009.02.D.12.a-g ot•the City Code, <br /> the City recognizes that certain <br /> protections for the Neighborhood <br /> Business District may not be in place <br /> to appropriately mitigate potential <br /> impacts to adjacent residential uses. <br /> Minnesota Statutes Section 462.355 <br /> allows the City to adopt a temI I <br /> interim ordinance for a period of up <br /> to twelve(12)months from the date <br /> it is effective,to allow for such study <br /> I and adoption,of comprehensive plan, P <br /> zoning and/or other official land use <br /> S controls in order to protect the public <br /> p health; safety and general welfare. <br /> The same statute allows for the <br /> I!mited extension of the period under <br /> particular.circumstances. <br /> The City has concluded that <br /> additional study_and analysis is <br /> required' to determine whether j <br /> the existing specific drive-through <br /> criteria in the Zoning Code requires <br /> modification or additionalcriteria to <br /> further protect adjacent residentially <br /> zoned properties from drive-through <br /> uses in the Neighborhood Business <br /> District. - <br /> There is a need for an interim <br /> ordinance to be adopted for the <br /> purpose of protecting the planning <br /> process and the health,safety,and <br /> welfare of the citizens of the City until <br /> such a study has been completed. <br /> SECTION 2:Prohibition <br /> Pursuant to State Statutes 462.355, <br /> the City hereby adopts and approves <br /> this interim ordinance temporarily <br /> prohibiting requests for a drive- <br /> through as a conditional use in-the <br /> Neighborhood Business District <br />
