Regular City Council Meeting
Monday,January 7,2019
Page 12
b. Consider Actions Regarding Hand in Hand Temporary School Structure at
2131 Fairview Avenue—Corpus Christi Church
City Planner Paschke briefly highlighted this item as detailed in the RCA and re-
lated attachments dated January 7, 2019.
Councilmember Etten asked if Hand in Hand Montessori has been using the space
in the last few days without a certificate of occupancy.
Mr. Paschke indicated the church has continued to utilize the space. The City has
not yet revoked anything. He noted the Interim Use is the only thing that has ex-
pired, and the use has not ceased because the City has not taken action on the mat-
ter yet.
Councilmember Groff asked why the sewer access charge fee was not paid on
September 1, 2016.
Mr. Paschke stated he could not answer that question, but the representative of
Hand in Hand Montessori probably can.
Councilmember Groff asked if Hand in Hand has received notice that the fees
have not been paid.
Mr. Paschke stated that was his understanding and the City is working with Hand
in Hand on getting the fees paid.
Mayor Roe noted Met Council is involved as well as part of the process.
Councilmember Etten asked if there was a dispute regarding the fee or is it just
not getting paid.
Mr. Paschke stated he did not know that off the top of his head, but he thought the
building official or Hand in Hand Montessori might be able to answer that ques-
tion.
Building Official Englund stated Hand in Hand has been notified several times
since the 2016 deadline for the SAC payment. There have been numerous discus-
sions back and forth and staff has done a redetermination request through Met
Council to see if the three SAC charges that were imposed were still the right
number for this site and staff did receive a redetermination of three SAC charges
due. Staff has been working with and notifying the tenant, Hand in Hand, to try
to secure that payment. Ultimately, he did have a discussion with the property
owner, Corpus Christi Church, who is actually responsible for the fees and has
been given an invoice for those fees after the December 31, 2018 deadline.
