This Temporary Construction Easement shall commence immediately and shall expire on <br /> November 30, 2019. <br /> The grant of the foregoing easement for construction purposes includes the right of the <br /> City, and its contractors, agents, employees, successors and assigns, to enter upon and use the <br /> Temporary Easement Area for, and in connection with, the construction of drainage, curbs, <br /> gutters, retaining walls, landscaped areas, and associated improvements, facilities, and <br /> appurtenances, on, over, across and through the Temporary Easement Area; to grade, level, fill <br /> and drain the Temporary Easement Area; to excavate culverts, cuts, slopes and ditches within the <br /> Temporary Easement Area; to remove and import soils from and into the Temporary Easement <br /> Area; to remove trees, brush, undergrowth and other obstructions from the Temporary Easement <br /> Area; to modify the parking lot curb line, relocating a portion of the curb and gutter in the <br /> Temporary Easement Area; and to do all other acts and things which are reasonably necessary <br /> for or incidental to the enjoyment of the easement rights granted herein. <br /> The consideration given herein includes full and complete payment for all damages <br /> incurred by the Grantor resulting from the removal of any and all trees, bushes, sod, landscaping, <br /> plantings and other vegetation, signs, fences, light posts, irrigation systems, and other <br /> obstructions from the Temporary Easement Area, and for relocation of the curb and gutter in the <br /> Temporary Easement Area. <br /> The foregoing easement shall be binding upon the Grantor, and its legal representatives, <br /> its successors and assigns, shall inure to the benefit of the City, and its successors and assigns, <br /> and shall run with the land until November 30, 2019. <br /> 2 <br />
