EXTRACT OF MINUTES OF MEETING <br /> OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br /> Roseville, County of Ramsey, Minnesota, was duly held on 6th day of May, 2019, at 6:00 p.m. <br /> The following members were present: Etten, Willmus, Laliberte, Groff, and Roe; and the following <br /> members were absent: None. <br /> Member Groff introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 11597 <br /> RESOLUTION AUTHORIZING MAYOR AND CITY MANAGER TO EXECUTE THE <br /> EARNEST MONEY CONTRACTS AND CLOSE ON EASEMENT ACQUISITIONS AT <br /> 2460 COUNTY ROAD C WEST <br /> WHEREAS,the construction of a public pathway along Walnut Street at 2460 County Road C West is <br /> consistent with goals in the draft 2040 Comprehensive Plan and the current 2018 Pathway Master Plan <br /> for the City of Roseville; and <br /> WHEREAS, in order to construct this pathway, it is necessary and desirous to obtain a new temporary <br /> construction easement and a permanent pathway easement; and <br /> WHEREAS, the construction of said pathway requires the acquisition of permanent and temporary <br /> easements from the property owner at 2460 County Road C West, as legally described in the earnest <br /> money contracts and easements in Exhibit A, attached hereto (the"Property"); and <br /> WHEREAS, the Public Works Department has negotiated with the Property owner for the purchase of <br /> the necessary temporary and permanent easements,together with damages for the relocation of a security <br /> fence and private landscaping, and the City Attorney has prepared earnest money contracts and <br /> easements attached hereto. <br /> THEREFORE, BE IT RESOLVED by the City Council of the City of Roseville, Minnesota: <br /> 1. The proposed acquisitions are in compliance with the City of Roseville Comprehensive Plan. <br /> 2. The acquisition of the proposed temporary and permanent easements at the Property is approved. <br /> The Mayor and City Manager are authorized to execute the earnest money contracts and take all <br /> actions necessary to perform the City's obligations under the earnest money contracts,including <br /> without limitation making payments for the easement purchases, closing costs and other costs, <br /> and executing any documents necessary to close on the acquisitions of the permanent and <br /> temporary easements. <br />
