Approve Resolution Approving the Acquisition of Easements at 1201 Lar- penteur Avenue Groff moved, Willmus seconded, adoption of Resolution No. 11596 (Attachment A) entitled, "A Resolution Authorizing Mayor and City Manager to Execute the Earnest Money Contracts and Close on Easement Acquisitions for Fernwood Lift Station." Approve Resolution Approving the Acquisition of Easements at 2460 County Road C Groff moved, Willmus seconded, adoption of Resolution No. 11597 (Attachment A) entitled, "A Resolution Authorizing Mayor and City Manager to Execute the Earnest Money Contracts and Close on Easement at 2460 County Road C West." Roll Call Ayes: Etten, Willmus, Laliberte, Groff and Roe. Nays: None. h. Approve Midland Crest Encroachment Agreement Groff moved, Willmus seconded, the Midland Crest Encroachment Agreement. Roll Call Ayes: Etten, Willmus, Laliberte, Groff and Roe. Nays: None. Approve University of Northwestern-St. Paul Agreement for Pedestrian Safety Improvements Groff moved, Willmus seconded, approving the Agreement of Assessment and Waiver of Irregularity and Appeal with the University of Northwestern-St. Paul. Councilmember Willmus asked who will be responsible for ongoing maintenance for those items. He wondered if this will be a cost share or will the City be re- sponsible for it all. City Attorney Gaughan believed the shared cost is for installation but mainte- nance would be the City's responsibility. Councilmember Willmus asked going forward if there are similar items like this, he would like to have a conversation on it.
