Regular City Council Meeting <br /> Monday, September 23, 2019 <br /> Page 13 <br /> Councilmember Groff asked in the future that staff do a search on developers in <br /> the City of Roseville. He thought five years was not an unreasonable length of <br /> time and if there are cases or issues against the developer, he would like to know <br /> that early on in the process rather than later on because this caught him off guard. <br /> Councilmember Willmus asked if a suggestion to Reuter Walton has been made <br /> with respect to this individual to actually trespassing him so that if he is caught or <br /> observed on a job site, he actually could be arrested for trespass. <br /> Ms. Gundlach indicated she has not asked that specific question of Reuter Walton. <br /> She did know that Reuter Walton did not hire Ricardo Batres, it was the subcon- <br /> tractor who hired him, and Reuter Walton did fire that subcontractor. She indi- <br /> cated she would follow up to see if there is an ability to actually trespass persons <br /> to their property. <br /> Mayor Roe indicated that is a technique used by retailers with habitual shoplifters. <br /> Councilmember Etten asked if there was anything in the contract that allows the <br /> city, to consider violations at another site to be a default or breach of contract or is <br /> it specifically the Roseville location where the finding of legal improprieties <br /> would have to be found. <br /> Ms. Gundlach explained the contract as written only where the city can take ac- <br /> tion based on the property in Roseville. It does not give staff the reach to go be- <br /> yond that. <br /> Councilmember Etten asked going forward if the city would be unable to write a <br /> contract to enforce something from outside of the city or is that something that the <br /> EDA attorney would need to be consulted on. <br /> Ms. Gundlach indicated the EDA attorney should be asked that question. It is <br /> very difficult to know what is going on at the sites in the city when staff is not <br /> there everyday so it would be difficult to go outside the city boundary. She noted <br /> she could put it on the list of things the city can do to be proactive. <br /> Councilmember Laliberte explained it is disappointing that there was knowledge <br /> out there prior to the EDA taking action and disappointing that the EDA was not <br /> fully made aware of all of the information that could have been made available to <br /> the EDA so it all could have been considered at the time. She appreciated the up- <br /> date and review that the EDA attorney has provided to them. <br /> Councilmember Laliberte indicated the city and KSTP have been focused on one <br /> person and the name he has been using but she would assume there are other peo- <br /> ple out there within this field of work who are bad. She would like to know more <br /> ideas about how photos of those individuals or pending charges, what can the de- <br />
