REQUEST FOR COUNCIL ACTION <br /> Date:October 7, 2019 <br /> Item No.: 7.c <br />Department Approval City Manager Approval <br /> <br />Item Description: Consider a Request to Issue an Administrative Citation for Unresolved <br />Violations of City Code at 1454 Shryer Avenue. <br />1 B ACKGROUND <br />2 The subject property is an owner-occupiedsingle-family home. <br />3 Current violations include: <br />4 o Outside storage of material and items in rear yard(City Code Section 407.02.G.3). <br />5 o Unapproved temporary structure(State Code R301.1). <br />6 On July 11, 2019 staff noticed the property of concerns during a Neighborhood Enhancement <br />7 Program Inspection. A re-inspection on July 23 verified violations to City Code remained. <br />8 This case was referred to Code Enforcement staff for follow up. <br />9 Code Enforcement staff conducted inspections on August 15 and September 20, 2019. <br />10 Notices were posted on the property July 11(NEP) and August 15, 2019. Mailed notices were <br />11 sent July 23(NEP) and September 20,2019. <br />12 The property owner submitted a permit application in May 2019 for a garage, staff discussed the <br />13 project and informed the applicant a variance would be required to construct the proposed <br />14 garage. The applicant has had discussions with planning division staff, however no variance <br />15 application has been receivedas of the writing of this report. <br />16 A status update will be provided during the Council discussion. <br />17 <br />18 After consultation with the City Attorney, there are two options: 1) abatement, and 2) pursuing an <br />19 administrative citation. The concern with the abatement process is the materials being stored outside <br />20 have value, should not be discarded, and would have to be stored. The administrative citation process <br />21 would impose a fine as a penalty for noncompliance, hopefully persuading the owner to comply. An <br />22 administrative citation could be imposed for every day the violation persists. Staff’s hope is this would <br />23 not have to be pursued, but it remains an option to consider in the future if the initial administrative fine <br />24 is not effective in securing compliance. <br />25 F INANCIAL I MPACTS <br />26 Administrative Citation: <br />27 An abatement would encompass the following (repair fees are estimates only): <br />28 City Code Violation (per 2019 fee schedule) $100.00 <br />29 <br />30 Total: $ 100.00 <br />Page 1 of 2 <br /> <br />
