<br />55 b.A microbrewery among the office, bank, retail, lodging, and restaurant uses that surround it <br />56 contributes to the commercial-area goal of “promot\[ing\] an appropriate mix of commercial <br />57 development types within the community.” <br />58 2. The proposed use is not in conflict with any Regulating Maps or other adopted plans. The site is <br />59 not subject to a regulating map, nor is the proposed use in conflict with the previously approved <br />60 PUD or its subsequent amendment. <br />61 3. The proposed use is not in conflict with any City Code requirements. Based on the plans that <br />62 have been received and reviewed thus far, staff have not uncovered any City Code conflicts, and <br />63 the proposed microbrewery must meet all applicable City Code regulations, or the applicant must <br />64 secure any necessary variance approvals, in order to receive the required construction permits. <br />65 Moreover, a conditional use approval can be rescinded if the approved use fails to comply with <br />66 all applicable City Code requirements or any conditions of the approval. <br />67 4. The proposed use will not create an excessive burden on parks, streets, and other public <br />68 facilities. The proposed microbrewery will not create an excessive burden on parks, streets, or <br />69 other public facilities because its impacts are expected to be comparable to the former restaurant <br />70 in this location, or many of the other uses permitted in the CB zoning district. <br />71 5. The proposed use will not be injurious to the surrounding neighborhood, will not negatively <br />72 impact traffic or property values, and will not otherwise harm the public health, safety, and <br />73 general welfare. Consistent with the preceding findings, the proposed microbrewery will be a <br />74 valuable addition to the surrounding commercial area, will not create adverse traffic impacts, <br />75 will positively affect surrounding property values, and will not cause harm to the public health, <br />76 safety, and general welfare, especially when compared to other uses permitted at the property. <br />77 Public Comment <br />78 The duly noticed public hearing for the conditional use application was held by the Planning <br />79 Commission on October 2, 2019. No members of the public spoke for or against the proposal, and at the <br />80 conclusion of the public hearing, the Planning Commission voted unanimously to recommend approval <br />81 of the proposed microbrewery as a conditional use. Draft minutes of the October 2 Planning <br />82 Commission meeting are included with this RCA as Attachment E.
