98 P OLICY O BJECTIVE <br />99 Promote high quality reinvestment. <br />100 Promote an appropriate mix of commercial development types within the community. <br />101 In receiving and reviewing this application, City staff have found the existing code provisions to be <br />102 somewhat problematic. For instance, some retail establishments currently have annual licenses for <br />103 amusement devices while other identical establishments do not—and none of these (or any other <br />104 existing amusement use)has applied for conditional use approval. Not only is it entirely possible that <br />105 new amusement devices or amusement areas crop up organically without a proprietor knowing about <br />106 these requirements; Planning Division staff have recently learned of exactly this situation playing out in <br />107 existing businesses. While staff across City Departments hope to consider changes to these regulations <br />108 in the near future, the present application must be evaluated based on the regulations currently in effect. <br />109 B UDGET I MPLICATIONS <br />110 Refer to DRC comments in Attachment D for any budget implications. <br />111 S TAFF R ECOMMENDATION <br />112 1. Adopt a resolution approving the proposed amusement area as a conditional use at 1955 County <br />113 Road B2, based on the content of this RCA, public input, and City Council deliberation. <br />114 2. Instruct City staff to research the origins of the existing “amusements” regulations and to bring a <br />115 recommendation to the City Council on maintaining, amending, repealing, or a combination <br />116 thereof, of those regulations. <br />117 R EQUESTED C OUNCIL A CTIONS <br />118 1. Adopt a resolution approving the proposed amusement area as a conditional use at 1955 <br />119 County Road B2, based on the content of this RCA, the public record, and City Council <br />120 deliberation. <br />121 2.
