EXTRACT OF MINUTES OF MEETING <br /> OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br /> Roseville, County of Ramsey, Minnesota, was duly held on the 25th day of November, 2019, at <br /> 6:00 p.m. <br /> The following members were present: Laliberte, Etten, Willmus, Groff, and Roe and the <br /> following members were absent: None. <br /> Councilmember Willmus introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 11650 <br /> APPROVING THE VACATION OF A PORTION OF COUNTY ROAD B LYING <br /> WEST OF MINNESOTA TRUNK HIGHWAY 280. <br /> WHEREAS, the Roseville City Council has determined on its own motion to vacate a portion of <br /> County Road B, a City street, on, over, and across the real property legally described in the <br /> attached Exhibit A (the"Property"); and <br /> WHEREAS, the portion of the street being vacated was excess trunk highway released to the <br /> City by the State of Minnesota in the Quit Claim Deed dated December 3, 1980, recorded <br /> February 10, 1981, as Document No. 2106681 (the "ROW"); and <br /> WHEREAS, a trunk highway released by the State of Minnesota becomes a municipal street <br /> that can only be released by using the vacation procedure in Minn. Stat. § 412.851. See J& W <br /> Asphalt, Inc. v. Belle Plaine Township, 883 N.W.2d 827 (Minn. App. 2016); See also Op. Atty. <br /> Gen., 377D, July 17, 1962; and <br /> WHEREAS, after two weeks published and posted notice have been given as well as notice <br /> having been mailed to all affected property owners according to Minnesota Statutes, a public <br /> hearing was held on November 25, 2019, at which all persons interested in said vacation were <br /> given an opportunity to be heard; and <br /> WHEREAS, the Roseville City Council has determined that the vacation would be in the public <br /> interest; and <br /> WHEREAS, at least four-fifths of all members of the City Council concur in this resolution. <br />
