To help bring this issue to the forefront, I am submitting a public information request for all data on <br />this survey, including the names and addresses of the interviewers used by Consultant and the <br />names and/or addresses of persons sampled, and also any additional data related to these two <br />groups, including telephone number and email address if available. Furthermore, I am requesting all <br />the data gathered under Exhibit C. <br />I am bringing this issue to your attention in hopes that it can be addressed in accordance with the <br />law. <br />In the past, when dealing with Morris Leatherman, they have attempted to claim that this <br />information is considered a Trade Secret. When reviewing IPAD opinions on Trade Secrets, they are <br />very clear that this is an extremely narrow category of exemption from the Act. It actually has to be <br />something like a scientific formula, etc. You may recall the battle over the source code for <br />intoxilyzers for example. This information is not a Trade Secret. <br />They have also played the game in the past claiming that they have deleted information and no <br />longer have it available when requests have been made after a survey is completed. That has <br />necessitated that I make the request at the point that the contract is signed so the city will now be <br />knowingly a participant in this process and attempt to retrieve the information. <br />It is my hope that this issue can be fully addressed and resolved in accordance with the law. <br />John M.
