1 EXTRACT OF THE MEETING OF THE CITY COUNCIL OF <br />2 THE CITY OF ROSEVILLE <br />3 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />th <br />4 Roseville, Ramsey County, State of Minnesota, was held on the 13day of April, 2020 at 6:00 p.m. <br />5 The following City Council Members were present: <br />6 And the following absent: <br />7 City Council Member introduced the following resolution and moved its adoption: <br />8 RESOLUTION NO. <br />9 A RESOLUTION MEMORIALIZING THE DENIAL OF A REQUESTFOR <br />10 A ZONING TEXT AMENDMENT TO TITLE 10 OF CITY CODE PERTAINING <br />11 TO HEIGHT LIMITATIONS OF ACCESSORY DWELLINGS (PROJ0017) <br />12 WHEREAS, the City of Roseville received a complete application for a zoning text amendment to <br />13 Title 10 of City Code pertaining to height limitations of accessory dwellings on February 7, 2020; and <br />14 WHEREAS, the Roseville City Council at its regular meeting on March 23, 2020, reviewed the <br />15 application along with the record of the public proceedings, including City staff report and public <br />16 consideration, by and between the City Council, and denied the application based on the following factual <br />17 findings: <br />18 1.The proposed text amendments constitute a significant departure from the original intent of <br />19 accessory structure height limitations in City Code. <br />20 2.The proposed text amendments present uncertainty in outcomes of future projects <br />21 attempting to interpret the proposed language pertaining to gable height standards. <br />22 3.The proposed text amendments do not incorporate a formal process for neighborhood input for <br />23 particular projects under the Code. <br />24 4.Given that current events may be impeding appropriate public participation in Council actions <br />25 such as the present case, the proposed text amendments are best approved only after a more robust <br />26 public participation process. <br />27 5.The proposed text amendments cause concern over large accessory structuresbeing placed within <br />28 five (5) feet of side property setbacks. <br />29 6.The City Council might be more supportive of similar textamendments that involve development <br />30 and planning processes that provide for a more robust public participation process. <br />31 <br />32 AND WHEREAS, said findings of fact underpinning the denial were reported to the applicant and <br />33 applicant in a letter dated March , 2020, <br />34 NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Roseville, Minnesota, <br />35 to memorialize for purposes of the record that the application discussed herein was denied March 23, <br />36 2020. <br />37 The motion for adoption of the foregoing resolution was duly seconded by Council Member <br />38 and upon a vote taken thereon, the following voted in favor: voted against. <br />39 WHEREUPON said resolution was declared duly passed and adopted. <br /> <br />
