Attachment B <br />411 West First Street <br />City of Duluth <br />Duluth, Minnesota 55802 <br />Legislation Text <br />File #:20-044-O,Version:1 <br />AN EMERGENCY ORDINANCE AMENDING CHAPTER 34 OF THE DULUTH CITY CODE BY ADDING <br />SECTION 34-45 REQUIRING FACE COVERINGS INDOORS SPACES OF PUBLIC ACCOMMODATION. <br />BY COUNCILORS FORSMAN, TOMANEK, KENNEDY, AND SIPRESS: <br />The city of Duluth does ordain: <br />Section 1.That Chapter 34 of the Duluth City Code is hereby amended by adding Section 34-45 as <br />follows: <br />Sec. 34-45.1. Face Covering Requirement - Purpose <br />(a)Facecoveringsareasimplebarriertohelppreventrespiratorydropletsfromtravelingintothe <br />airandontootherpeoplewhenthepersonwearingthefacecoveringcoughs,sneezes,talks,orraisestheir <br />voice. This is called source control. <br />(b)RespiratorydropletsspreadthevirusthatcausesCOVID-19andrecentevidencefromclinical <br />and laboratory studies show face coverings reduce the spray of droplets when worn over the nose and mouth. <br />(c)COVID-19spreadsmainlyamongpeoplewhoareinclosecontactwithoneanother(within <br />about6feet),sotheuseoffacecoveringsisparticularlyimportantinsettingswherepeopleareclosetoeach <br />other or where social distancing is difficult to maintain. <br />(d)Social distancing is difficult to maintain indoors business establishments. <br />Sec. 34-45.2. Definitions. <br />For the purposes of this Article, the following words and phrases shall mean: <br />(a)ASpaceofPublicAccommodationmeansabusiness,oraneducational,refreshment, <br />entertainment,orrecreationfacility,orpublictransportation,oraninstitutionofanykind,whetherlicensedor <br />not,whosegoods,services,facilities,privileges,advantages,oraccommodationsareextended,offered,sold, <br />orotherwisemadeavailabletothepublic.Examplesincluderetailstores,rentalestablishments,DuluthTransit <br />Authoritybuses,facilities,andbusshelters,governmentbuildings,theDuluthSkywalksystem,placesof <br />worship,andserviceestablishmentsaswellaseducationalinstitutions,recreationalfacilities,andservice <br />centers. <br />(b)FaceCoveringmeanswearingafacemask,faceshield,N95respirator,neckgaiter,orfitted <br />piece of material that: <br />(1)Covers the mouth and nose; <br />(2)Fits snugly against the side of the face; and <br />(3)Is secured on the face. <br />Sec. 34-45.3.
