S. Failure to provide adequate notice (within two hours of Contractor's decision to delay <br />collections) and coordination to prevent mixed public messages about collection <br />delays due to severe weather incidents — $2,000 per incident. <br />T. Failure to accurately and promptly answer a resident's question to the Contractor's <br />customer service call center — $100 per incident. <br />U. Employees smoking in enclosed structures while performing uties, extinguishing <br />smoking material anywhere other than in container or not following general no - <br />smoking rules — $50 incident. <br />V. Failure to provide accurate call center responses o eviller ts' questions per <br />the City's FAQs guidance document — $500 de . <br />W. Failure to follow the federal or state equal opportunit laws and rules = <br />incident. <br />The Contractor shall be liable for liquidated damages in the amount(s) upon determination of the <br />City that performance has not occurred consistent with the provisions of the Contract. The City <br />shall notify Contractor in writing or ele onically of each act or omission in this Contract <br />reported to or discovered by the City. It all be the duty of Contractor to e whatever steps or <br />action may be necessary to remedy the cause of the complaint. <br />The City may deduct the full amount of any amage ro any payrhent due to the Contractor. <br />The remedies available to the City under this paragraph shall be in addition to all other remedies <br />that the City may have under law or at equity. <br />5.6 Ser ices Not Provided For <br />No claim for services furnished by the Contractor not specifically provided for herein shall be <br />RFP for City of Roseville Recycling Services • A-26 <br />
