<br />VILLAGE COUNCIL OF ROSEVILLE <br />Continued meeting Saturday, October 24, 1953, at 9:00 A.M. <br /> <br />The Village Council met on the above date as a continuation of the regular <br />meeting of Tuesday, October 20, 1953, with the following members present: <br />Carlson, Connor, Membrez, Hammersten and Ira Karon, Village Attorney, was <br />also present. <br /> <br />The hearing on Lebens rezoning was called to orqer. Therebeing no one <br />present objecting to the petition, Membrez moved, Hammersten seconded, <br />that the following property be rezoned to Business: <br /> <br />WWest one-half (Wi) of the Southeast quarter (sEt) of <br />the. Southwest quarter (SWi) of the Southwest quarter <br />(SWi) of Section Fourteen (14), Township Twenty-nine (29) <br />Range Twenty-three (23)." <br /> <br />Roll call Ayes-(4) Nayes-(O). <br /> <br />Membrez moved, Hammersten seconded, that the licenses from the Depot Nite <br />Club be transferred to Edw. Krier. Roll call Ayes-(4) Nayes-(O). <br /> <br />Markham appeared before the council with an easement for a road on Burke <br />and Pascal. He inquired if some stakes eould be set so he could do the <br />grading. The papers he had had certain stipulations in it that he could <br />not meet. <br /> <br />Carley arrived at this time and said his crew was setting the stakes this <br />morning to be paid for by Bentley. When this is done, Zibells have agreed <br />to sign the easement.,for Wallace Bentle~. <br /> <br />Karon presented the matter of the lawsuit Schubring vs. Leuer and Village <br />of Roseville. He explained what had transpired legally through the years <br />and that two court actions had been held previously. The council requested <br />that Karon take the neutral position and let ~uer and his attorney carry <br />on the suit. <br /> <br />The clerk read a letter from Karon on the matter of a primary election <br />outlining the dates of a primary election. <br /> <br />WWith reference to whether or not a primary election can be <br />held for the 1953 Village election the following procedure must be <br />followed. If notice of a special election to vote upon the question of <br />having a primary election was given on October 24, 1953, and notice <br />thereof posted on October 26, 1953, the election upon said question <br />could not be held before November 5, 1953, as 10 days posted notice <br />thereof is required. If a majority of the voters voted for a primary <br />election system the votes could not be canvassed until November 6, <br />1953. Allowing 10 days for filing by candidates the last day for <br />filing would be November 16, 1953. Filings must be closed at least <br />20 days prior to the primary election so that the primary election <br />could not be held until December 6, 1953. The statute provides that <br />the primaries must be held not less than 10 days preceding the <br />Village election and the Village election must be held upon December <br />8, 1953. It is, therefore, apparent that a primary election cannot <br />be held in connection with the 1953 Village elections.
