Replacement trees shall be from balled and burlapped, certified nursery stock as defined and 3882 <br />controlled by MN Stat. 18.44 through 18.61, the Plant Pest Act, as may be amended from time to 3883 <br />time. Replacement trees may also be from bare root stock, provided the trees are planted no later 3884 <br />than May 15th in any year, and the planting is inspected by the City Forester or other degreed 3885 <br />forester or certified arborist as assigned by the Community Development Department. 3886 <br />4. Replacement trees shall be covered by a minimum 2-year guarantee in accordance with Section 3887 <br />1011.04(M). 3888 <br />5. When heritage trees are removed, replacement trees options shall be as determined by the City 3889 <br />Forester or other degreed forester or certified arborist as assigned by the Community 3890 <br />Development Department. 3891 <br />6. Replacement trees for significant and common trees may be selected by the applicant, but all final 3892 <br />planting plans shall be subject to review and approval by the City Forester or other degreed 3893 <br />forester or certified arborist as assigned by the Community Development Department, who will 3894 <br />determine whether the proposed trees are suitable to the site, are well placed, and accomplish 3895 <br />local diversity goals. 3896 <br />7. Replacement trees may be utilized to meet landscaping and screening requirements if placement, 3897 <br />species, and location are consistent with those requirements. 3898 <br />8. Replacement Tree Locations. Required replacement trees shall be planted on the site being 3899 <br />developed unless doing so is deemed to be impractical (i.e. due to lack of space), inappropriate 3900 <br />(available planting areas are not ideal for new plantings or would do little to enhance the site), or 3901 <br />counterproductive to a property’s intent (i.e. would entail too much screening for a retail 3902 <br />business) as determined by the City Forester or other degreed forester or certified arborist as 3903 <br />assigned by the Community Development Department. When such a determination is made, the 3904 <br />applicant shall comply with replacement requirements in one of three ways in the following 3905 <br />manner: 3906 <br />a. As directed by the City , required replacement trees may be located on private property within 3907 <br />1000 feet of the subject development site with the consent of the property owner(s), on public 3908 <br />improvement project sites that are not greater than 1000 feet from the development site, or on 3909 <br />other public and private lands that are not greater than 1000 feet from the development site if 3910 <br />such lands are deemed to be available, with priority given to locations near the affected area; 3911 <br />or 3912
