a. Any tree, not previously identified for removal, that is determined by the City Forester or 3949 <br />other degreed forester or certified arborist as assigned by the Community Development 3950 <br />Department to be destroyed or damaged as a result of development activity shall be replaced 3951 <br />at the following rates: 3952 <br />Category Replacement Rate <br />Heritage Trees 2.5 <br />Significant Trees 1.5 <br />Common Trees 1.0 <br />b. Unauthorized tree removal which results in mandatory replacement shall require the applicant 3953 <br />to prepare or update a final planting plan as required by Section 1011.04(G)(3)(c). 3954 <br />Replacement plantings shall only occur once authorized by the City Forester or other degreed 3955 <br />forester or certified arborist as assigned by the Community Development Department. 3956 <br />L. Certification of Compliance with Approved Landscape Plan. Upon completion of construction 3957 <br />activity and/or required landscaping, the Developer shall notify the City and request an inspection of 3958 <br />the work. Following the inspection, the City shall notify the Developer that additional work is still 3959 <br />required, or issue a letter finding that all plantings have been satisfactorily completed. The required 3960 <br />warranty period for plantings shall begin on the date of the issued satisfactory completion letter. 3961 <br />M. Warranty Requirement 3962 <br />1. New Development Sites: The Developer shall provide a financial guarantee, in a form satisfactory 3963 <br />to the City, prior to the approval or issuance of any permit for land alteration. 3964 <br />a. The amount of the guarantee shall be 125% of the estimated cost to furnish and plant 3965 <br />replacement trees. The estimated cost shall be provided by the Developer subject to approval 3966 <br />by the City. The estimated cost shall be at least as much as the reasonable amount charged by 3967 <br />nurseries for the furnishing and planting of replacement trees. The City reserves the right in 3968 <br />its sole discretion to determine the estimated cost in the event the Developer’s estimated cost 3969 <br />is not approved. 3970 <br />b. The security shall be maintained for at least 2 years after the date that the last replacement 3971 <br />tree has been planted. Upon a showing by the Developer and such inspection as may be made 3972 <br />by the City, that portion of the security may be released by the City equal to 125% of the 3973 <br />estimated cost of the replacement trees which are alive and healthy at the end of such year. 3974 <br />Any portion of the security not entitled to be released at the end of the year shall be 3975 <br />maintained and shall secure the Developer’s obligation to remove and replant replacement 3976 <br />trees which are not alive or are unhealthy at the end of such year and to replant missing trees. 3977 <br />Upon completion of the replanting of such trees the entire security may be released. 3978 <br />2. Development or Redevelopment of Existing Lots: The developer shall provide a cash escrow in 3979 <br />the amount of $500.00 to guarantee compliance with the requirements of this Ordinance. Said 3980 <br />security shall be released upon compliance by the developer to the satisfaction of the City. 3981 <br />Notwithstanding the foregoing, no portion of the security shall be released while there are 3982
