REQUEST FOR COUNCIL ACTION <br />Date: May 11, 2020 <br />Item No.:7.b <br />Department ApprovalCity Manager Approval <br />Item Description:Adopt an Ordinance amending City Code Section 1011.04.J.8 regarding <br />Replacement Tree Locations <br />1 B ACKGROUND <br />2 During the November 25, 2019 joint Planning Commission and City Council meeting, the Planning <br />3 Commission requested City Council support to amend the Tree Preservation and Restoration <br />4 ordinance to prevent unreasonably high costs associated with the cash-in-lieu tree replacement <br />5 payment. This request was in response to two variance requests from July of 2019 involving <br />6 construction of single family homes. During the joint meeting, the Council requested additional <br />th <br />7 information from staff, and that information was provided at meetings held on February 10and <br />th <br />8 March 9, 2020. Rather than direct the Planning Commission to consider amendments to the <br />9 ordinance, the Council provided direction to staff on revised ordinance language based upon the <br />10 circumstances surrounding the two variance requests. Those ordinance revisions were advanced to <br />11 the Planning Commission for the required public hearing on May 6, 2020. <br />12 The Planning Commission held the required public hearing on May 6, 2020. No persons from the <br />13 public provided testimony. The Planning Commission voted unanimously to recommend City Council <br />14 approval of the Ordinance amending City Code Section 1011.04.J.8. The Planning Commission <br />15 expressed appreciation to the Council for advancing these changes. Draft Planning Commission <br />16 minutes were not available for inclusion in this report. <br />17 P OLICY O BJECTIVE <br />18 The City of Roseville recognizes that trees are a significant element of the community given their <br />19 beauty, their importance to the environment, and their positive impact on property values. The purpose <br />20 of Chapter 1011.04, Tree Preservation and Restoration, is to ensure trees are protected when they are <br />21 most vulnerable, establish reasonable requirements for replacement of trees lost due to development, <br />22 incentivize the protection and planting of trees at all times, institute plan requirements to ensure tree <br />23 loss can be identified prior to development, that adequate replacement plantings will occur following <br />24 land disturbances, and to provide for fair, effective, and consistent enforcement of tree preservation <br />25 requirements. <br />26 B UDGET I MPLICATIONS <br />27 Staff does not expect substantive budget implications by reducing the cash-in-lieu cap to 5% of the <br />28 assessed land value for single family homes. This is because the cash-in-lieu cap is estimated to be <br />29 applied once a year. Further, none of this revenue isbudgeted. While the holistic impact is deemed <br />30 non-substantive, the impact to the affected individual property owner is significant. <br />Page 1of 2 <br /> <br />
