Attachment A <br />1 ORDINANCE NO.____ <br />2 <br />3 AN ORDINANE AMENDING TITLE 10 (ZONING), <br />4 CHAPTER 1011 (PROPERTY PERFORMANCE STANDARDS) <br />5 REGARDING REGULATIONS RELATED TO <br />6 REPLACEMENT TREE LOCATIONS <br />7 AND CASH-IN-LIEU PAYMENTS <br />8 <br />9 The City Council of the City of Roseville does ordain: <br />10 <br />11 Section 1. Tree Replacement Locations.After Planning Commission and City Council <br />12 consideration, the Roseville City Code, Title 10 (Zoning), Chapter 1011 (Property Performance <br />13 Standards) is hereby amended as follows: <br />14 <br />15 1011.04 TREE PRESERVATION AND RESTORATION IN ALL DISTRICTS: <br />16 <br />17 J.8. Replacement Tree Locations. Required replacement trees shall be planted on the site being <br />18 developed unless doing so is deemed to be impractical (i.e. due to lack of space), inappropriate <br />19 (available planting areas are not ideal for new plantings or would do little to enhance the site), or <br />20 counterproductive to a property’s intent (i.e. would entail too much screening for a retail business) <br />21 as determined by the City Forester or other degreed forester or certified arborist as assigned by the <br />22 Community Development Department. When such a determination is made, the applicant shall <br />23 comply with replacement requirements in one of three ways in the following manner: <br />24 a. As directed by the City, required Replacement trees may be located on private <br />25 property within 1000 feet of the subject development site with the consent of the property <br />26 owner(s), on public improvement project sites that are not greater than 1000 feet from the <br />27 development site, or on other public and private lands that are not greater than 1000 feet <br />28 from the development site if such lands are deemed to be available, with priority given to <br />29 locations near the affected area; or <br />30 b. The City may accept a cash-in-lieu tree replacement payment in accordance with <br />31 the required fee listed in the City Fee Schedule. In no instance shall a cash-in-lieu of <br />32 payment exceed 10%of the Fair Market Valueassessed land value of the development site, <br />33 except that for a single family lot the cash-in-lieu of payment fee shall not exceed 5% of <br />34 the assessed land value; or <br />35 c. The City may approve a combination of tree replacement in accordance with “a” <br />36 above and a payment consistent with “b” above to fulfill this requirement. <br />37 <br />38 Section 2. Effective Date.
