Attachment A <br />EXTRACT OF MINUTES OF MEETING <br />OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />* * * * * * * * * * * * * * * * * <br /> <br />1 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />th <br />2 Roseville, County of Ramsey, Minnesota, was duly held on the 18 day of May, 2020, at <br />3 6:00p.m. <br />4 <br />5 The following members were present: ; and and the following members were absent: <br />6 <br />7 <br />8 Councilmember introduced the following resolution and moved its adoption: <br />9 <br />10 RESOLUTION NO. <br />11 <br />12 APPROVING THE VACATION OF A PORTION OF SEWER EASEMENT AT <br />13 511 HEINEL DRIVE <br />14 <br />15 WHEREAS, the Roseville City Council has determined on its own motion to vacate a portion of <br />16 a sewer easement, on, over, and across the real property legally described in the attached <br />17 ExhibitA (the “Property”); and <br />18 <br />19 WHEREAS, the portion of the easement being vacated (the “ROW”) was dedicated to the City <br />20 in the Vi’s Lakeshore Plat, Ramsey County, Minnesota in 1972; and <br />21 <br />22 WHEREAS, after two weeks published and posted notice have been given as well as notice <br />23 having been mailed to all affected property owners according to Minnesota Statutes, a public <br />24 hearing was held on May 18, 2020, at which time all persons interested in said vacation were <br />25 given an opportunity to be heard; and <br />26 <br />27 WHEREAS, the Roseville City Council has determined that the vacation would be in the public <br />28 interest;and <br />29 <br />30 WHEREAS, at least four-fifths of all members of the City Council concur in this resolution. <br />31 <br />32 NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />33 ROSEVILLE, MINNESOTA: <br />34 <br />35 1. That the City of Roseville hereby vacates the ROW. <br />36 <br />37 2. The vacation applies only to the right-of-way described in Provision 1 and not to: (a) the <br />38 rights of existing utilities, if any, and (b) any other easements running to or benefiting the <br />39 City of Roseville, if any. <br /> <br />
