We conclude that the City Council can make findings under <br />the ordinance that the PUD Agreementis no longer required because: <br />1.Current zoning for Rosedale Center has been updated since the PUD Agreement <br />was entered intoand the current zoning allows improvements and redevelopment to <br />Rosedale in an orderly manner consistent with the City’s Comprehensive Plan; <br />2.The PUD Agreementcurrently covers only a portion of the Rosedale Center property <br />which, in turn, means that portions of Rosedale Center are essentially zoned <br />differently than other portions because the overlay district only applies to a portion of <br />the site; and <br />3.As redevelopment occurs at Rosedale Center consistent with current City zoning, <br />additional amendments of the PUD Agreementmay also be required which adds an <br />unnecessary and additional step to the approval process. <br />For these reasons, we request that the City Council adopt an ordinance providing for the <br />cancellation of the PUD Agreement. <br />50 South Sixth Street | Suite 1500 | Minneapolis, MN | 55402-1498 | T 612.340.2600 | F 612.340.2868 | dorsey.com <br />4813-2544-1454\\1 <br /> <br />
