As you know, your licenses for multi- <br />family rental properties are currently revoked under Council Resolution 11653, which was passed <br />10 months ago. The purpose of this correspondence is to provide notice of the deficient progress <br />in remedying your property and, as a result, the anticipated recommendations to the Council at an <br />upcoming meeting. <br />First, it is clear that you are not able to satisfy the Council’s conditions for license reinstatement. <br />Indeed, City staff has regularly documented not only your failure to even approach code <br />compliance across the numerous buildings on your property, but also your failure to fulfill the <br />Council’s requirement that you employ a professional property management firm and a <br />professional property maintenance technician. Despite the City’s patience over the last 10 months, <br />the living conditions for the majority of your tenants have not materially improved. <br />S <br />econd, Ramsey County records show that you have been transferring ownership of the buildings <br />on your property.Under City Code 908.03.F, rental licenses are not assignable and new ownership <br />entities must file an application with the City within 30 days of acquisition. License reinstatement, <br />even if it was conceivable, would not apply to the current property owner. <br />For these reasons, this office and City staff intend to recommend that the City Council order further <br />legal action against your property, pursuant to Condition I of Resolution 11653 and City Code <br />908.04.D. Specifically, the Council will be urged to authorize the filing of a petition in Ramsey <br />County District Court under the Minnesota Tenant’s Remedies Act, Minnesota Statutes Section <br />504B.395, et seq. Be advised that, under the Act, a court may order that an administrator undertake <br />all necessary corrective actions on the property, using collected rents to finance such remedies.
