Attachment C <br />218 B.When an appeal is filed, a public meeting regarding the mattershall be held before the <br />219 City Council, acting as the Board of Adjustments and Appeals, at a regular meeting held <br />220 within thirty (30) calendar days of the receipt of the appeal. The Board of Adjustments <br />221 and Appeals may consider any of the evidence that had previously been considered as <br />222 part of the formal action that is the subject of the appeal. New or additional information <br />223 from the appealing applicant(s) may be considered by the Board of Adjustments and <br />224 Appeals at its sole discretion if that information serves to clarify information previously <br />225 considered by the Chief of Police and/or Community Development Director. <br />226 C.Appeals filed under this section shall require notification to properties within 350 feet of <br />227 the subject property. <br />228 <br />229 909.12: MAINTENANCE OF RECORDS: <br />230 <br />231 All records, files and documents pertaining to the Short-Term RentalLicenseProgram shall <br />232 be maintained in the office of the City and made available to the public as allowed or <br />233 required by applicable laws, rules, codes, statutes or ordinances. <br />234 <br />235 909.13: AUTHORITY: <br />236 <br />237 Nothing in this Chapter shall prevent the City from actingunder any applicable rule, <br />238 standard, statute or ordinance for violations thereof and to seek either injunctive relief or <br />239 criminal prosecution for such violations as therein provided. Nothing contained in this <br />240 Chapter shall prevent the City from seeking injunctive relief against a property owner or <br />241 designated agent who fails to comply with the terms and conditions of this Chapter including <br />242 an order prohibiting the occupancy of such rental units until violations of this Chapter have <br />243 been remedied by the property owner or designated agent. <br />244 <br />245 909.14: APPLICABLE LAWS: <br />246 <br />247 Short-Term Rental Property shall be subject to all applicable rules, standards, statutes and <br />248 ordinances governing use, maintenance and occupancy of the dwelling or dwelling unit; and <br />249 this Chaptershall not be construed or interpreted to supersede any other such applicable <br />250 rules, standards, statutes or ordinances. <br />251 <br />252 909.15: RULES, POLICIES, PROCEDURES: <br />253 <br />254 The City Council may adopt from time to time, by resolution, rules, policies and procedures <br />255 forthe implementation of this Chapter. Violation of any such rule, policy or procedure by a <br />256 property owner shall be considered a violation of this Ordinance. <br />257 <br />258 909.16: NO WARRANTY BY THE CITY: <br />259 <br />260 By enacting and undertaking to enforce this Ordinance, neither the City, its designees, the <br />261 City Council, or its officers, agents or employees warrant or guarantee the safety, fitness or <br />262 suitability of any dwelling in the City.
