REQUEST FOR COUNCIL ACTION <br /> Date:September 28, 2020 <br /> Item No.: 7.c <br />Department Approval City Manager Approval <br /> <br />Item Description:Consider Approving a Tobacco Sales Violation Presumptive Penalty for Chuchao Liquor <br /> <br />1 B ACKGROUND <br />2 On Tuesday, August 11, 2020, at 1:15 p.m., a plain clothes Roseville police officer, along with an 18- <br />3 year-old underage compliance checker, entered Chuchao Liquor, located at 700 County Road B, <br />4 Roseville, Minnesota, to conduct a tobacco compliance check. The underage compliance checker <br />5 approached the front register and requested to purchase a back of Newport cigarettes.The cashier <br />6 processed the sale and provided the cigarettes without asking for identification. The plain clothes <br />7 officer identified himself as a police officer. The cashierwas administratively cited for the violation <br />8 and the administrative fine was paid on August 31, 2020. <br />9 This is Chuchao Liquors second tobacco violation in the past twenty-four (24) months. On November <br />10 15, 2018, an employee sold an underage compliance checker tobacco without checking their <br />11 identification. The cashier and the business paid the administrative fine (ref CN 18036947).The <br />12 business failed an alcohol compliance check on July 26, 2017. <br />13 The Roseville Police Department seeks Council approval to issue and administer the presumptive <br />14 penalty pursuant to City Code Section 306.09, for tobacco license holders for the second violation <br />15 within twenty-four (24) months. The mandatory minimum penalty shall be a four hundred dollar <br />16 ($400.00) fine and a two (2) day suspension. <br />17 B UDGET I MPLICATIONS <br />18 Pursuant to City Code Section 306.09, the financial impact shall be a mandatory penalty of a four <br />19 hundred dollar ($400.00) fine and a two (2) day suspension issued to the license holder for the second <br />20 violation within twenty-four (24) months. <br />21 S TAFF R ECOMMENDATION <br />22 Staff recommends Council approval to issue and administer the presumptive penalty pursuant to City <br />23 Code Section 306.09, for tobaccolicense holders for the second violation within twenty-four (24) <br />24 months.
