REQUEST FOR COUNCIL ACTION <br /> Date:September 28, 2020 <br /> Item No.: 7.a <br />Department Approval City Manager Approval <br /> <br />Item Description: Consider Approving a Liquor Sales Violation Presumptive Penalty for Maya Cuisine <br />Restaurant <br /> <br />1 B ACKGROUND <br />2 In July 2020, all businesses with a city liquor license were mailed a letter announcing two citywide <br />3 alcohol compliance checks to be conducted before the end of the calendar year. The letter included <br />4 information on the Roseville City Ordinance regarding the mandatory liquor licensee training program <br />5 and penalties for noncompliance. A copy of the letter was also e-mailed to all license holders. <br />6 On Wednesday, August 19, 2020, at 2:00 p.m., a plain clothes Roseville police officer, along with an <br />7 18-year-old underage compliance checker, entered Maya Cuisine Restaurant, located at 1595 Highway <br />8 36, Roseville, Minnesota, to conduct an alcohol compliance check. The underage alcohol compliance <br />9 checker and plain clothes officer sat down at the bar. The underage checker ordered a Coors Light <br />10 bottled beer. The employee asked the checker for his identification. The checker provided his <br />11 Minnesota photo provisional driver’s license which displayed a year of birth of 2001 and an “under 21” <br />12 banner above the photo. The employee briefly looked at the ID and then sold the underage compliance <br />13 checker the beer. The compliance checker paid for the beer. The plain clothes officer identified himself <br />14 as a police officer. The server could not explain why she sold the beer to the underage checker. The <br />15 server was administratively cited for the violation and the administrative fine was paid on August 28, <br />16 2020. <br />17 Maya Cuisineprovided copies of their employee/manager training records. The employee involved in <br />18 the violation was in the process of being trained in and had notcompleted a server training program. <br />19 Maya Cuisinehassince provided training to all of their employees and is now at 100% compliance for <br />20 server training. This is their first violation. <br />21 P OLICY O BJECTIVE <br />22 The Roseville Police Department seeks Council approval to issue and administer the presumptive <br />23 penalty pursuant to City Code Section 302.15, for on-sale license holders for the first violation within <br />Page 1 of 2 <br /> <br />
