REQUEST FOR COUNCIL ACTION <br />Date:September 28, 2020 <br />Item No.:7.h <br />Department ApprovalCity Manager Approval <br />Item Description:Continued discussionregarding the regulation of short-term rentals <br />1 BACKGROUND <br />2Over the course of the last summer, several complaints have been received regarding offensive <br />3activities occurring at homes that are rented on short-term basis. Those offensive activities <br />4include loud parties, excessive parking, noise (including offensive language), and drug use. As a <br />5result of those complaints, and requests by residents impacted by short-term rentals, the City <br />6Council requested staffresearch options for the possible regulation ofshort-term rentals. <br />7 <br />8Currently, there are 553 registered rentals in Roseville. A cursory search of short-term rental <br />9platforms has revealed advertisements for 24 short-term rentals in the City, with most being a <br />10rental of a single room within an otherwise owner-occupied residence. <br />11 <br />12On August 24, 2020, a first discussion regarding the regulating of short-term rentals was <br />13presented before City Council(minutes provided as Attachment D). Beyond the information <br />14presented by staff, numerous members of the public provided testimony in regard to short-term <br />15rental impacts. Testimony was given by residents who are negatively impacted by short-term <br />16rentals, as well as by owners of short-term rental properties. <br />17 <br />18 Significant takeaways from the first discussion: <br />191.Council would like to continue discussion with staff and consider draft code <br />20languageto regulate these uses within residential neighborhoods. <br />212.The intent with regulation should be to limit negative impacts, such as noise, <br />22excessive parking, offensive activities and language, smoke (from bonfires), and <br />23illegal activities including public intoxication and drug use, noting the frequency <br />24of these types of negative impacts is higher under a short-term rental arrangement <br />25verses a more traditional rental arrangement. <br />263.Use of properties solely for the purpose of social or commercial events should be <br />27prohibited–defining/discerningwhat constitutes a “social” or “commercial” <br />28eventcould be difficult. <br />294.Short-term rentals could haveaminimum required duration of rentalin an effort <br />30to limitthe rental for the sole purpose of holding an event. <br />315.Maximum capacity of occupants could be set, however distinguishing between <br />32someone renting/staying at the home versus a visitor couldbe difficultand a <br />33requirement to allow City review of a lease may not be permissible/practical. <br />346.Consider requirements forcollection of alocal Lodging Tax. <br />357.A more definedprocess is needed to enforceregulations, including existing <br />36regulations in Chapter 907. <br />378.There appears to be no concerns regarding rentals when the home iscontinuously <br />38owner-occupiedduring the rental period. <br />39 <br /> <br />
