Attachment A <br />1 EXTRACT OF MINUTES OF MEETING <br />2 OF THE <br />3 CITY COUNCIL OF THE CITY OF ROSEVILLE <br />4 * * * * * * * * * * * * * * * * * <br />5 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />th <br />6 Roseville, Minnesota, was duly held on the 12 day of October, 2020, at 6:00 p.m. <br />7 The following members were present: , , , , and Mayor , and the <br />8 following were absent: . <br />9 Member introduced the following resolution and moved its adoption: <br />10 RESOLUTION No. <br />11 RESOLUTION APPROVING THE VACATION OF A CONSTRUCTION EASEMENT <br />12 LOCATED ON LOT 3, BLOCK 1, ROSEDALE CENTER SEVENTH ADDITION, <br />13 RAMSEY COUNTY, MINNESOTA <br />14 WHEREAS, the Roseville City Council has determined on its own motion to vacate a temporary <br />15 construction easement on, over, and across the real property legally described on the attached <br />16 Exhibit A (the “Property”); and <br />17 WHEREAS, the Property is subject to a perpetual easement for construction, maintenance, and <br />18 repair of underground storm sewer mains, pipes, and appurtenances (the “Perpetual Easement”) <br />19 and a temporary construction easement lying Northeasterly of and adjoining said Perpetual <br />20 Easement (the “Temporary Construction Easement”) in favor of the City of Roseville, as <br />21 described in the Easement NO. 12 dated July 1, 1970, filed in the Office of the Registrar of <br />22 Titles, Ramsey County, Minnesota, on July 10, 1970, as Document No. 547637; and <br />23 WHEREAS, the easement to be vacated is the Temporary Construction Easement; and <br />24 WHEREAS, after two weeks’ published and posted notice having been given, as well as notice <br />25 having been mailed to all affected property owners according to Minnesota Statutes, a public <br />26 hearing was held on October 12, 2020, at which all persons interested in said motion were given an <br />27 opportunity to be heard; and <br />28 WHEREAS, the Roseville City Council has determined that the vacation would be in the public <br />29 interest; and <br />30 WHEREAS, at least four-fifths of all members of the City Council concur in this resolution. <br /> <br />
