<br />REQUEST FOR COUNCIL ACTION <br />Date: November 30, 2020 <br />Item No.: 9.g <br />Department Approval City Manager Approval <br />Item Description: Approve Resolution Approving Petition for Partial Transfer of Ramsey <br />County Ditch 4 <br />1 B ACKGROUND <br />2 At the July 27, 2020 meeting, the City Council approved a Cooperative Agreement with the Rice <br />3 Creek Watershed District for Improvement to Ramsey County Ditch 4 (RCD 4). This agreement <br />4 laid out cost participation and terms for a project to place the current open ditch segment of RCD 4 <br />5 between County Road C and Terrace Drive into a pipe section for the betterment of the drainage <br />6 system as well as water quality improvements downstream. As part of this agreement, the City also <br />7 agreed to accept the transfer ofownership of this portion of the RCD 4 as well as the currently piped <br />8 portion south of County Road C and the lateral south and east of the identified segment. A map <br />9 showing the segments in question is included as Attachment C. <br />10 Per Minnesota State Statutes Section 103E.812, the City must formally petition the watershed <br />11 district for this transfer of ownership. This is an official acknowledgement that we are willing to <br />12 take on permanent ownership and maintenance of these drainage ways. Again, the City has already <br />13 committed to this per the recently approved Cooperative Agreement. <br />14 A resolution is attached approving the petition and authorizing the Mayor and City Manager to <br />15 execute the formal petition and return it to the Rice Creek Watershed District. <br />16 F INANCIAL I MPACTS <br />17 The petition itself does not carry any direct costs to the City in order to execute the transfer of <br />18 ownership. While section 15 of the attached petition indicates that the City is responsible for all <br />19 costs related to the transfer, the aforementioned and recently approved Cooperative Agreement <br />20 (referred to as a Memorandum of Agreement within the petition) supersedes this portion of the <br />21 petition, which is required by State Statutes. Per the agreement, any costs related to any future <br />22 public hearings or notifications of impacted property owners, attorney fees, engineering costs, etc., <br />23 will be paid by the Rice Creek Watershed District. <br />24 The future ownership and maintenance costs of the newly transferred sections will cost the City <br />25 about $3000 per year on average, according to estimates by City staff based on recent maintenance <br />26 activities of similar piped sections. Future operating budgets and CIP’s will be adjusted as necessary <br />27 to account for these additional costs but we do not recommend any changes to the 2021 budget as a <br />28 result of this transfer. <br />29 S TAFF RECOMMENDATION <br />30 Staff recommends Council approve a resolution approving a petition for the partial transfer of <br />31 Ramsey County Ditch 4 from the Rice Creek Watershed District to the City of Roseville. <br />Page 1 of 2 <br /> <br />
