45 <br />46 <br />ATTACHMENT B <br />47 <br />48 <br />49 <br />50 <br />51 WHEREAS, City Code Section 908.01 acknowledges the operation of a Multifamily <br />52 Rental Dwelling is a business enterprise that entails responsibilities on the owner to <br />53 assure that residents and children may pursue the normal activities of life in <br />54 surroundings that meet safe, secure, and sanitary criteria, and <br />55 <br />56 WHEREAS, beginning on September 16, the City received 15 complaints from residents <br />57 regarding fire code issues, building code issues, and pest infestation at the Marion <br />58 Street/The Brittanys Apartments; and <br />59 <br />60 WHEREAS on September 17, 2019, in accordance with City Code Section 908.03 (H) a <br />61 preliminary inspection of the Marion Street/The Brittanys Apartments was conducted by <br />62 city inspectors that determined the complaints received from the tenants were valid and <br />63 that due to the extent to which violations were noted there was a need to conduct a full <br />64 and comprehensive inspection of all buildings and units; and <br />65 <br />66 WHEREAS, on October 11 and 14, 2019, city inspectors conducted a comprehensive <br />67 inspection of the Marion Street/The Brittanys Apartments consistent with Roseville City <br />68 Code Chapter 908, inspecting 90 of the 277 units in all 12 buildings of which access was <br />69 provided by G & G Management LLC to city inspectors; and <br />70 <br />71 WHEREAS, during those inspections on October 11 and 14, 2019, city inspectors found <br />72 violations of Minnesota State Fire Code, Minnesota State Building Code, and Roseville <br />73 City Code at the Marion Street/The Brittanys Apartments that included significant <br />74 maintenance issues, and numerous life safety and code violations. A summary of these <br />75 violations is attached to this resolution as Exhibit A; and <br />76 <br />77 WHEREAS, these inspections revealed a failure rate of 100% of the units and common <br />78 areas inspected, with violations so pervasive an itemized list of unit and building <br />79 numbers, as typically provided, was not practical being the extent to which corrections <br />80 were needed encompassed 100% of the units across all 12 buildings, and <br />81 <br />82 WHEREAS, as a result of a 100% failure rate, city inspectors provided written notice, <br />83 dated November 4, 2019, to G & G Management, LLC of the violations noted seeking <br />84 corrections of these violations to all 277 units in all 12 buildings, including common <br />85 areas, and <br />86 <br />87 WHEREAS, in accordance with the letter provided by the City dated November 4, 2019, <br />88 G&G Management LLC was required to correct the life safety issues and provide the <br />89 City with a comprehensive plan that outlines a timeline to address all documented code <br />90 violations at Marion Street/The Brittanys Apartments by November 18, 2019; and <br />91 <br />92 WHEREAS, G & G Management LLC, upon receipt of the City's letter dated November <br />93 4, 2019 requested the November 18, 2019 inspection be moved up to November 13, <br />94 2019, which was confirmed and granted via a letter dated November 5, 2019, and <br /> <br />
