He noted Phase two is being discussed and reviewed but <br />227 Phase one (south of Terrace Drive) is moving forward. <br />228 <br />229 Etten moved, Groff seconded, approving the Public Works 2021 Work Plan. <br />230 <br />231 Roll Call <br />232 Ayes: Willmus, Strahan, Etten, Groff and Roe. <br />233 Nays: None <br />234 <br />235 d.Discuss Considering Amendments to Title 3, Section 306 Cigarette and To- <br />236 bacco Products of the City Code Including Prohibiting the Sale of Flavored <br />237 Tobacco Products in the City of Roseville <br />238 City Manager Patrick Trudgeon briefly highlighted this item as detailed in the Re- <br />239 quest For Council Action and related attachments dated January 11, 2021. <br />240 <br />241 Councilmember Willmus asked with respect to off-sale alcohol, the City has the <br />242 ability to limit the number of those licenses and he wondered if something similar <br />243 to that could potentially be done to tobacco shops. <br />244 <br />245 City Attorney Gaughan indicated the Council could limit the number of licenses if <br />246 done with articulable, supportable basis. He knew the City of St. Paul had limited <br />247 the number of tobacco licenses. <br />248 <br />249 Mayor Roe indicated it seemed they could limit the overall number of licenses <br />250 across the whole City, which is what St. Paul did. If the Council wanted to limit <br />251 the number of licenses to a particular type of establishment, that is where the Coun- <br />252 cil needs to articulate who those entities are and why. <br />253 <br />254 Councilmember Strahan explained in reviewing the logs (petitions) these stores <br />255 were presenting to the City Council, many who were buying and signed these, lived <br />256 outside of Roseville. She asked staff to explain what specific items are outlawed <br />257 in adjacent cities that are of value or interest and allowed in Roseville. She also <br />258 indicated the Council is interested in the litigation in Arden Hills and how that <br />259 would be impacted based on how the City Ordinance is currently proposed. <br />260 <br />261 Mr. Trudgeon explained to the best of his knowledge, the cities of Minneapolis, St. <br />262 Paul, as well as Falcon Heights and Lauderdale do allow for the sale of tobacco <br />263 including flavored in 21 plus stores, meaning liquor stores and tobacco stores. Fla- <br />264 vored products are not allowed for sale in gas stations and drug stores. He under- <br />265 stood that there had been some work in convenience stores to convert a section to <br />266 a separate entrance to become a tobacco only store. He noted in the City of Lauder- <br />267 dale, the city council may be considering a complete ban on flavored tobacco and <br /> <br />
